3/11: Former Bomb Disposal Unit Chief Denounced for Disappearance of Physical Evidence

Forceful Complaint against Manzano for the Homicide Weapon of 3/11

The Association for Aiding of the 3/11 Victims has presented Wednesday a complaint against the former chief of TEDAX [bomb disposal unit], Sanchez-Manzano, for omission of his duty of persecuting crimes, cover-up by concealment of evidence and false testimony regarding the 3/11 attacks.

Not very often a complaint reflects in so exact form and well related the facts that motivate it as the one written by the lawyer Jose Maria de Pablo. The Association for Aiding of the 3/11 Victims has presented this Wednesday in the Madrilenian Courts of Plaza de Castilla his announced complaint against the former chief of the TEDAX Juan Jesus Sanchez-Manzano. They accuse him of omission of his duty of persecuting crimes, cover-up by concealment of evidence and false testimony. No accusation is left without probatory load: the testimonies of the own Sanchez-Manzano, those of the expert of the TEDAX and those of several chiefs and agents of the department.

The sentence of the 3/11 trial maintained that “the trademark of the dynamite which exploded in the trains is not known with absolute certainty”. A lack of knowledge by the court of the National High Court that judged the facts that for the Association for Aiding of the 3/11 Victims begins in the “cover-up and false testimony” of the former person in charge of the TEDAX, Juan Jesus Sanchez-Manzano and the female leader of the laboratory of the TEDAX.

In the forceful 41 page complaint, the association of victims that presides over Angeles Dominguez denounces the concealment to the Scientific Police of the samples picked up in the twelve explosion scenes in the attacks of March 11, 2004 by Sanchez-Manzano.

The victims denounce that during March 11 and 12, the TEDAX gathered “all kind” of samples from the four places of the brutal attacks (stations of Atocha, Santa Eugenia and El Pozo, along with the Madrilenian Tellez street) so that it was possible to clarify what substance exploded in the trains and who were their authors. Those “kilograms and kilograms” of samples were in charge of Sanchez-Manzano.

The Action Protocol was not followed

Those samples, following the official Action Protocol that during the trial the own operative general assistant director of the National Police, Pedro Pintado-Diaz, exposed, are sent “always” to the laboratory of the General Offices of the Scientific Police, where the definitive scientific analyses are carried out, since the work of the TEDAX when an attack occurs limits to a first analysis “to orient the investigation units”.

Nevertheless, the victims declare that the former chief of the TEDAX, Sanchez-Manzano, did not send those rests of the explosions (sand, earth, fabrics, some ketone and water samples, etc) to the Scientific Police so that they could continue with the investigation. “That is, probably, the first occasion in the last twenty years in which the TEDAX prevents the Scientific Police of analyzing the samples from the explosion scenes in a terrorist attack”, emphasizes the complaint.

During the 3/11 trial, Manzano argued that this shipment had not taken place because “the rests of the explosions were never sent to the Scientific Police”. Nevertheless, in a report sent by this police corps to the court of the National High Court that judged the case, is stated that Sanchez-Manzano had signed “in several occasions” the remission to the Scientific Police of exploded rests from different attacks.

That same kind of rests that during the trial Manzano stated that were never sent, and what according to the victims, prevented the investigation to determine without any doubt the trade name of the explosive used by the terrorists in 3/11.

In addition, the Association for Aiding of the 3/11 Victims has also complained against the female chief of the TEDAX laboratory since this one “had in her hands and analyzed rests corresponding to the 12 explosion scenes and made disappear the extracts of water and ketone obtained during her analyses, thus preventing any further test or analysis”.

Only one part of those rests was washed with water and ketone by the chief of the laboratory, whereas the rest was stored without following any treatment. But a second report elaborated by experts at the request of Penal branch of the National High Court concluded that rests not washed with water and ketone, which were the majority since from each one a small part is extracted to be analyzed, had disappeared. Altogether, the chief of the TEDAX laboratory kept 23 samples (which do not reach the number of two samples per explosion scene, as screws and nails) from the initial kilograms of material that was picked up.

For the victims, the defendants “hid to the Scientific Police the hundreds of rests that the TEDAX had gathered in the explosion scenes, preventing a scientific analysis which would have favored the clarification of the facts; they hid the immense majority of the rests coming from the explosion scenes, among them, the more valuable for the investigation (those that were not washed with water and ketone), preventing the eight experts designated by the court from analyzing them; they made disappear the extracts of water and ketone in which some vestiges were washed; and even nowadays the defendants continue hiding that immense majority of disappeared rests, whose whereabouts are still unknown”.

Cover up and false testimony crimes

For that reason they ask Justice to investigate if Sanchez-Manzano, the female chief of the TEDAX laboratory, as well as “the rest of people who the court determines”, have incurred in the crimes of omission of their duty of persecuting crimes, cover up by concealment of evidence and false testimony related to the 3/11 attacks.

The Association for Aiding of the 3/11 maintains that “the absence of awarding of responsibilities in this issue forces us to assume our responsibility in this fight and to act accordingly”. With this complaint, the victims want to make use of their right to know the truth “against all the issues that remain unsolved”. They also emphasize that “the dark actions of some individuals must not in any case of put in doubt or stain the good reputation and the integrity of the members of the Corps and Forces of Security of the State”. In this sense, the majority unions of the Police, the Unified Police Union (SUP) and the Spanish Police Confederation (CEP), have indicated that the complaint against Sanchez-Manzano should have to point "upwards" [in the chain of command].

The mentioned "disappearances" attributed to the defendants are:

1. In general, it has disappeared the stones from the platform, as well as the cottons impregnated with water and ketone that - according to the Police inspector #28,296 – were gathered in all the trains.

2. The samples that have been conserved from Atocha station are surprising meager for the magnitude of the facts.

3. All the rests from one of the Tellez street explosion scenes have disappeared. 4. From the explosion scene #3 in Tellez have disappeared all the vestiges, with the exception of a miserable nail. 5. The samples of sand, earth, cotton, water and ketone that a TEDAX Official assured to have gathered from the train of Tellez have disappeared.

6. The earth samples that were taken from the crater of the controlled explosion in El Pozo, according to what appears in the photography of page 53,835; volume 145 from the 3/11 Judicial summary have disappeared.

7. It has also disappeared the fabric samples, insulating material, and earth that the forensic expert #17,632 assured to have received in her laboratory and analyzed in the morning of day March 11th.

Sanchez-Manzano, the chief of the TEDAX during 3/11, had previously sued EL MUNDO newspaper and the civic association Peones Negros (this later complaint was rapidly rejected by the judge since this association simply publishes footage from the trial itself). An analysis by Luis del Pino follows:

Very hard the report from the Office of the public prosecutor in the case of the complaint by the fomer chief of the TEDAX, Sanchez-Manzano, against the newspaper EL MUNDO and several of its journalists. The public prosecutor has decided not only to deny the support for the pretensions of Sanchez-Manzano but, in addition, instead of being against them simply invoking a series of arguments in favor of the freedom of information and speech, what has done is to indicate specifically that the affirmations by the newspaper EL MUNDO were truthful.

The Office of the public prosecutor confirms, for instance, that the former chief of the TEDAX failed to fulfill the existing rules when he did not send the samples gathered from the trains to the Scientific Police. It also confirms that the laboratory of the TEDAX lacked the technical means available in the laboratory of the Scientific Police. It also confirms that the habitual practice, before and after 3/11, was to send to the laboratory of the Scientific Police the samples. He confirms that Sanchez-Manzano included in a report metenamine as component of Goma2-ECO which is erroneous. He confirms that Sanchez-Manzano incurred in contradictions when he talk about the impossibility of determining the components of the explosives after a detonation. He confirms that the existence of a x-ray on the backpack of Vallecas was hidden to the judge Del Olmo…

The report from the Office of the public prosecutor constitutes an authentic blow for Sanchez-Manzano, who will have to face the next month of August the complaint presented by the Association for Aiding of the 3/11 Victims, that represents more than 600 victims of the attacks. As it constitutes a true blow for all those who, from different political levels and the mass media, have tried to convince the public opinion that the investigation of the attacks was correct.

It is not truth that the investigation was correct. The official version of 3/11 is an immense swindle to the public opinion, in which the real evidences of the case were stolen to the Spaniards (all which came from the trains) and, instead of them, appeared a series of evidences "found" outside the trains (van of Alcala, backpack of Vallecas,…) which were used to divert the investigations towards the Islamist thesis. The summary of 3/11 is just an immense, and a tragic one, monument to birlibirloque.

And the role of Sanchez-Manzano in those vitiated investigations comes out to be the darkest. But let me say something to discharge the former chief of the TEDAX: it is unthinkable that he was the one who decided, by his own will, to turn the summary of 3/11 into a swindle. It is immensely doubtful, for instance, that the decision of not sending the samples of the trains to the Scientific Police was his and only his. But also it is clear that who has the key there is the own Sanchez-Manzano. If there were somebody, above or below [in the chain of command] him, who made that decision to do all the necessary to hide the explosives of the trains, then Sanchez-Manzano has the opportunity to tell us all who that person is.

At this moment, the accusing finger of suspicion points towards that former head of the TEDAX during 3/11. But on him it depends that the finger begins to indicate the right direction. I believe that the victims of the massacre would be thankful to him for any gesture aiming at clarifying what was what happened in the immediate hours after the attack.

As also I believe it would be thankful for his own conscience.

It has long been understood that the Spanish socialists shamelessly exploited the March 11, 2004, terrorist attacks in Madrid’s train station for political advantage. They did so with palpable disregard for a frightening fact: The far-reaching geostrategic repercussions of that incident — which vaporized the ruling conservative party’s electoral lead just days before the polling — gave those seeking similar results elsewhere every incentive to engage in violence against other democracies’ electoral processes.

First of all, I like that movie.

Secondly, the jihadists did not carried out the coup, but probably mercenaries paid by a member of the Spanish oligarchy, Catalonian branch, which is the one that has obtained more profits from the coup.

Irregardless of how good the TEDAX lab (and apart from the political interference, it doesn’t sound very good) it is strange that, in an investigation of this scale, multiple labs were not involved in the investigation. Besides the federal authorities, local and provincial police authorities and EU labs should have been involved and at least provide assistance. That way, multiple similar conclusions can form into one conclusive solution. That one lab was given full authority over this case is suspicious in and of itself.

Indeed, no counter analysis could be carried out. Moreover, Israeli help was rejected just hours after the attack.

Furthermore, in the laboratory of the Scientific Police were awaiting for the evidences from the trains forensic experts Escribano and Lopez, who had proved, putting at risk their careers, that they would not tolerate any manipulation.

It also the laboratories of the Civil Guard don't seem to cooperate too much with Manzano when they pointed out to judge Del Olmo that metenamine is not a component of Goma-2 ECO, and that it did not appear in other samples linked to the suspects.

In the end, it seems clear the task of firewall developed by this police officer who, maybe for that reason the last phrase in Luis del Pino report, it is said to live in Alcalá, from where many victims came from.

He doesn't look them to their faces.
