Reading the Constitution, it is apparent that Obama could be either a British or Kenyan citizen even if he was born in Hawaii and his mother could apply to be a Kenyan citizen.

On February 17, 1964 the formal title of the country was the “Dominion of Kenya”. It became the “Republic of Kenya” on December 12, 1964, about 10 months later.

someone needs to find out what was the title of the country was on other registrations of birth on this day to see if they match

could it have considered itself a Republic before the name was offically changed?

I'm sure a lot of paperwork occurred during the transition including creating the forms for the new nation and transferring the information from the British documents. This was before computers, and creating new birth/citizen certificates for all Kenyans would have been quite a process.

If the document is fake, I don't think it will be debunked because forms were being created and information being transferred before the official independence day. There are even newspaper articles talking about the transition to independence years before it happened. It would be stupid to become a new nation and not know who your new nation's citizens are from the start.

Could the proud new father have tried to make sure his new son (was he the first son?) was registered a Kenyan, even while born in Honolulu?

The Constitution of Kenya
Chapter VI: Citizenship87*. Persons who became citizens on 12th December, 1963

1. Every person who, having been born in Kenya, is on llth December. 1963 a citizen of the United Kingdom and Colonies or a British protected person shall become a citizen of Kenya on 12th December, 1963: Provided that a person shall not become a citizen of Kenya by virtue of this subsection if neither of his parents was born in Kenya.

2. Every person who, having been born outside Kenya. is on llth December, 1963 a citizen of the United Kingdom and Colonies or a British protected person shall, if his father becomes, or would but for his death have become, a citizen of Kenya by virtue of subsection (1). becomes a citizen of Kenya on 12th December. 1963.

Looks like Kenya's Constitution made both Daddy and Baby 0 citizens of Kenya on December 12, 1963 DESPITE the fact Zero [might, maybe, possibly] being born in Hawaii.
