So much for my prediction of 75 votes to confirm; with Sessions, Kyl, and now even Maverick against her, shell be lucky to break 70. Im honestly stunned, for the same reason Hotline is:
McCain voted against Sotomayors nomination to the 2nd Circuit Court of Appeals in 98, so his decision is not entirely surprising. But like his friend and GOP colleague, Sen. Lindsey Graham (SC), McCain has decried the politicization of judicial nominations that led to a failed Dem filibuster of Justice Samuel Alito. Graham, citing a desire to start over on the Senates advise and consent role, was the only GOP member of the Senate Judiciary Cmte to support Sotomayors nomination last week.
Maverick was part of the Gang of 14 too, which makes it doubly surprising. His supposed reason for voting no is her long record of judicial activism but Im not sure what he means by that. The only decision of hers that the GOP spent any serious amount of time attacking was Ricci and that was handed down just 18 months ago. Likewise, as Ive said in a few other posts, shes never had a reputation for being a lefty ideologue on the bench; were talking about a former prosecutor, after all.
Its her speeches that raise the prospect of judicial activism, but why should they be taken as more predictive of how shell rule than her actual opinions? Shes closer to the center than any Obama nominee is likely to be, so if shes not qualified, none of them will be which I think is the deeper message McCains trying to send here.

I voted for McLame, and of course I would do it again, but saying that he’s better than Obama isn’t saying much.
Naah. He’s up for reelection, and his base is going to be furious by next Fall, count on it.
It will not do him any good but the least he can do is steer his flame out away from any populated areas before he ejects.
Feeling the heat from his next run for Senate in his home state....they all come around when their power base is really, really threatened.
It's election time for McCain. A few days ago a McCain letter was posted with him concerned about border security.
If McCain is reelected, he'll be back to resting his head in Teddy Kennedy's lap in no time.
No surprise, he’s up for reelection in 2010
Every 5.5 years McCain as his re-election rolls around, he starts throwing a few bones to conservatives in Arizona. Right after he gets another term he goes back over to the left side of the aisle and co-sponsers leftist bills.
I'm glad he voted against the 'wise latina' not that it will do any good.
