In addition, most of these state will be among those that separate from the USA and become part of a separate Conservative nation.
A P.S. The three west coast states would be cut off from their eastern liberal-state comrades! How sweet it is...
Especially if they use the ATF’s own insane determinations as to what constitutes “construction” against the ATF.
Popcorn time...
Bump to the top!
Treasure State Patriots in Big Sky country!
The bho administration would draw a perforated line across the Constitution if they could get away with it.
The bho administration will fight Montana over this and lose everything.
What would happen? Civil War II?
I believe not. It's a different time; different thinking; different feelings; different politics.
Revolutionary War II? Again,...too many differences.
Most likely the Fedgov would have to give in. Does anyone really believe that the Military, under orders of the Executive Branch, would KILL their own families in this era? This is not the 1800's - never happen.
Plus, the Governors of any rebellious States could maintain control over their State National Guard, not to mention the 100's of thousands of armed Patriots standing by. RWII will not happen as long as the States continue on this path.
I am finally encouraged for our Republic to see so many States (37?) passing resolutions regarding States' rights via the 10th Amendment. Although resolutions are non-binding, it says a lot about the current thinking of the individual States.
This is a cause we should all support! This is our way back to the Founding Fathers' brilliance for limited federal governance.
Yes, it is. This State law could be either the way back to our FF's ideals or the issue that ignites a backlash against the USSC.
I only hope the Supremes have the wisdom to negate the abused "commerce clause" and recognize States' rights regarding this issue. If not - IT'S ON!
I'm standing by. I will not end my life a subject of the United States of Socialist Republic.
Health Care Reform is another bridge to die on for Freedom’s Defenders.
The Federal Government has taken many powers unto itself it doesn’t have, through the Interstate Commerce clause and no doubt other dubious claims. So this isn’t a new phenomenon but boy is it ever picking up steam and thundering downhill like a juggernaut now.
They have no right to force me to buy an insurance product, or right to design an insurance product either in the private or public sector which I’m forced into by hook or crook, nor right to fine me through my bank account or through the IRS withholding and refusal to refund if I don’t acquiesce to their insurance schemes.
My state must defend the right of all state citizens to retain these rights granted to us by the Constitution.
Whatever it takes to defend us.
Don't be ridiculous.
The trouble is that this law only applies to guns in which there’s already a national market, like the farmer’s wheat from that other infamous commerce clause case, and not machine guns, in which the national market is strangled, which even the Supreme Court acknowledged.
The Feds will probably just make the same argument that they made back then - that locally-produced firearms “affect” interstate commerce in firearms by reducing sales of non-Montana firearms in Montana.
If they hadn’t excluded machine guns, they might have a better case since the interstate market in machine guns is so minimal, but at least they included silencers which fall under the same regulatory regimen as machine guns.
Movin to Monta-ana soon.....
So, what happens once the SCOTUS shoots this down?
More from Montana,related to 10th.
This is precisely what Constitutionalists should have been doing for the last 50 years, i.e. picking apart the Federal overreach one bit at a time based strictly on clearly defined Constitutional issues.
I’m a huge 2A guy, but the rest of our state rights must also be retaken in the same type of manner. “Regulation of interstate commerce” has been used as a catch all to completely trample state’s rights. We need to get back to being a Republic of individual states.
Secession yesterday, secession today, secession FOREVER! LOL.
GO MONTANA!! We’ve got your back.
