Panic in D.C. ? Justice urges birth suit tossed

The U.S. Justice Department is urging a federal judge in California to dismiss a lawsuit challenging the constitutional eligibility of Barack Obama to hold the office of president.

The highly anticipated hearing tomorrow morning before Judge David Carter features attorney Orly Taitz and numerous plaintiffs, as well as a document that one person has sworn is the original birth certificate of Obama from Kenya – not Hawaii, where the administration maintains Obama was born.

In a motion filed Friday in Santa Ana, Calif., attorneys for the government did not directly address the merits of Taitz's claims, but instead focused their efforts on technical procedures, suggesting the matter can't be decided in court and that the dozens of plaintiffs cannot demonstrate they have been injured by having Obama in the Oval Office.

"It is clear, from the text of the Constitution, and the relevant statutory law implementing the Constitution's textual commitments, that challenges to the qualifications of a candidate for president can, in the first instance, be presented to the voting public before the election, and, once the election is over, can be raised as objections as the electoral votes are counted in the Congress," wrote Assistant U.S. Attorneys Roger West and David DeJute. "Therefore, challenges such as those purportedly raised in this case are committed, under the Constitution, to the electors, and to the Legislative branch."

Why are DOJ lawyers involved? Why isn’t Obama paying his own lawyers to fight this? So now the DOJ feels they can walk in and tell a judge what to do?

Um, the argument for this would be the troops dying because of his orders.
So, yes people are nut just hurt, they're dying because of his orders

I have noticed. It is an agency totally out of control. When you have long-time employees telling Holder and company not to dismiss charges against the new Black Panthers in Philly, and they do anyway, it speaks volumes that Holder will do what he wants. Holder doesn’t care about the Rule of Law at all.

Wonder how many laws Holder has broken?

Even with a dozen Kenyan eyewitnesses, a verifiable Kenyan birth certificate, and home movies, NO court will EVER rule Resident Soetoro ineligible, nor will they ever even hear the case.

He’s POTUS and his interests are probably being handled by the Office of the Solicitor General. Their arguments are fairly sound. There is no judicial mechanism in the Constitution to remove a sitting POTUS. That exists in Art One and is in the hands of the Congress. The fact that Congress would do nothing is irrelevant to the lack of judicial power. The matter of the removal of the Cherokee in violation of an injunction from SCOTUS has shown that a sitting POTUS with the approval of the Congress can violate the law, as also Lincoln, with the approval of Congress violated the Constitution in the matter of habeus corpus.

I don’t know all the legal technicalities about DOJ entering as attorneys for the defendants, but once DOJ did entered as representing the defendants, it essentially became their duty (as all defendants’ attorneys do in all cases) to file a motion to dismiss the case. The plaintiffs have the opportunity to oppose the motion. A motion to dismiss is not anything special, really.

Are they there under an amicus motion? If so how can they move for dismissal?

Obviously we are over the target. The frothing fools try to pull out he stops.And the argument is specioius if the facts in issue were neither before the People during the election, nor before the College of Electors and the Leagislators after the election.

Prediction: DOJ loses.
