A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.
If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.
In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.
In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.
But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

My question is more a legal one. If he became Soetoro, can he reappear magically someday as Obama without legally changing it back. Is he really Obama anymore?

Well, for one thing, I don't think a Hawaiian birth certificate actually even exists, especially if he was born in Kenya as his paternal grandmother & his aunt attest to.
Secondly 0bozo is literally blocking every other piece of information about his entire background, including school records from his Indonesian school, his Hawaiian high school, Occidental college, Columbian Univ & Harvard Univ. He has multiple social security numbers assigned to him, multiple listings of residences, complete blockage of his state senate records, a U.S. passport that was not issued to him until he became a U.S. senator and the good ol' boys club green lighted a way for him to get a U.S. passport without a U.S. birth certificate, but likely just the fraudulent certificate of live birth. Basically the usurper 0bozo is a walking POS of thousands of unknowns & inconsistencies, all being covered for him by the interconnected web of leftist organizations & the shilling MSM.
I wonder how many American kids there were in Indonesia in the early 1970s? Enough for a whole school? If mama was so intent on homeschooling him, I wonder why Lolo Soetro adopted him (to give him cover of Indonesian citizenship) and enrolled him the local madrassa and registered him as a muslim?

No it wasn't. The defense filed their motion to dismiss only last week. The judge has to allow Taitz time to examine the motion and respond with her reasons why the case should continue. That's why the judge gave her 30 days and scheduled the hearing on the motion on October 5th.

Notice the wording: She asked if any EVIDENCE was available. She did not ask if there were any objections that could then be debated and documents subpoenaed.
I think alot of people are missing the boat on the signifigance of this news today.
Obama for the first time is openly using tax payer dollars to argue that no Amercan citizen has standing and that no Court has jurisdiction to challenge his eligibility.
This is really big news. I think it will now start to draw more media attention because of this.
No Obama supporter can argue anymore that Obama is not fighting this case. He is now for the first time using taxpayer dollars and has hs official stance in print.
The Obama official stance is that no Court or no citizen has a right to challange his elgibility. He no longer can hide behind private lawyers. This is now an official administration stance.
BArry turned into Barry Soetoro while still living in Hawaii, when Lolo adopted him after marrying Stanley Ann. Barry was taken to Indonesia to live and attend school as the son of Lolo Soetoro. Later, Stanley Ann sent him back to Hawaii to live with Toot and Sanley senior. HOWEVER, Barry turned eighteen in August 1979, if his birth date is correct. Stanley legally divorce Lolo in 1980 and in August or September of 1979 Barry entered Occidental college.
In the divorce pleading from Stanley Ann, she claimed Lolo had two children he was legally responsible for, one over eighteen. That would be Barry Soetoro! So, when Barry entered Occidental he was still the legal son of Lolo Soetoro and an Indonesian citizen UNLESS there are documents filed in Hawaii which show he had a legal name change prior to 1980. BUT he was still considered the legal son of Lolo in 1980 so it is likely that he has used dual citizenship and gamed the systems of schools and perhaps passports on more than one occasion. So, if there are no official name change documents dating to prior to 1980, Barry is likley still legally Barry Soetoro and he has perjurded himeself as well as committed fraud on various actions regarding school entry, tuition, and passports.
You might find it interesting that Barry registered--supposedly in 1980--for Selective Service as Barack Hussein Obama. He may have actually legally been Barry Soetoro at the time he supposedly registered for SS. Just another of the many anomolies of this affirmative action liar.

Your the one crowing on about all the judges who’ve dismissed their cases for lack of standing, most often on the first wiff they get. Carter has had two opportunities to follow that same path.

What's the hurry? Why not wait until 2016 when the entire case will be moot?
Why is the Justice Department involved up to their neck in this case, anyway? How come we taxpayers get to foot the bills for The Kenya Fraud's defense arrangements?
