Shocker! Judge orders trial on eligibility issue

A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.

If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.

In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.

In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.

But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

One of the larger problems for me is that DOJ attorneys have a huge conflict of interest in this case. Their oath is to the Constitution, not to the POTUS. They should be defending the Constitution first.

Obama will be getting very nervous very soon. If discovery is allowed to proceed, Obama will produce the evidence he is qualified to be president within days if he is qualified in order to put this case behind him. Any attempts at further delay will almost be an admission that his is not constitutionally qualified.

I think Any delay has signified he is hiding something, and until proven otherwise, he is not constitutionally qualified. I like Ed Vieira's comment,"If he knew at the inauguration he was not a natural born citizen, then it's a Perjured Oath." Is that why the bumbling of the oath on both sides?

Did Judge Carter really mention troops today?

4 Marines died in Afghanistan and it appears a lot of the reason is Obama Rules of Engagement (ROE). They were pinned down but could not call in air strikes or artillery because the Talban had women and children around.

Judge Carter was in Afghanistan recently. As a Marine - I am sure he spoke with young Marines over there. I hope he knows the score.

Afghanistan is a waste of time now if our soldiers cannot fight back, we have an Islamo CIC and if Obama is letting Muslims flood into America. My guess is the Hamas and Muslim Brotherhood moles in the White Hut are leaking intel back to the Taliban and Al Qeada to kill our troops.

Don't like my answer? Take it up with Chief Justice John Roberts. He seemed to have no objection towards personally administering the Oath of Office.

Imagine this:

• You sold your car to a buyer who paid you with a fake Cashier's check;
• You deposit the check and everything seems ok, so you hand-over the keys and the title;
• A month later, you bank notifies you that the Cashier's check was fake, so you have now lost both the money and the car;

Should the fraudulent buyer get to keep your car just because you accepted the payment? Not a chance! Instead, you are likely going to seek the power of the court to restore what was taken from you by deceit.

Voters accepted Barack Obama's qualifications, as did Chief Justice Roberts, because no concrete evidence of the fraud had been presented in a manner sufficient to change their actions. Now, citizens are seeking to have the power of the court fix this mistake.

The judge, who is a former U.S. Marine, repeated several times that this is a very serious case which must be resolved quickly so that the troops know that their Commander in Chief is eligible to hold that position and issue lawful orders to our military in this time of war. He basically said Obama must prove his eligibility to the court! He said Americans deserve to know the truth about their President!

There ya' go! Sounds very credible to me. Their Oath says it + Any statute hidden somewhere that says Just That + other conflict of interest legalese, etc? I'm not an attorney, but it sure as hell sounds like a conflict of interest to me and the judge ought to Demand they recuse themselves and Obama get a private attorney. Plus where does it say in matters of constitutional eligibility BEFORE he was elected that we NOW have to pay his legal fees? ?

The Birthers invented a make-believe requirement found nowhere in the Constitution that "Natural Born" is defined as being born on U.S. soil to parents who were both American citizens.

More on that subject may be found here. The common understanding is, citizen at birth == natural born citizen. Vattel, etc., is futile fantasy.

If you don't qualify as a 14th Amendment Citizen, you can't possibly be a Natural Born Citizen.

Not true. The 14th covers folks born here not of diplomat parents. However, others born abroad to US citizen(s) are also Natural Born. E.g., John McCain, whose estimable service to the Republic should have ended decades ago.
