Shocker! Judge orders trial on eligibility issue

A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.

If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.

In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.

In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.

But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

1.Judge Cater works with Nakazato on a regular basis and has a close, cooperative work relationship.

They understand each other. Carter is not going to worry about Nakazato torpedoing him.

2. Judge Carter does NOT throw close colleagues under the bus. Not his style. Should it become necessary he will find a work around to allow justice to be done.

get real! You are spinning the record. I read the document from your link and you are slanting facts, with great support from NonSequitor to suit you and not peripheral aspects of those decisions.

Why do you have such antipathy toward Orly? If you think you can help go volunteer on a pro-bono basis. She is funding he own efforts and if you agree with the Usurper being led out of the people’s hoouse in handcuffs then instead of throwing barbs at her, go help her out.

Otherwise, if you have nothing good to say, silence would be golden.Bad mouthing her does you no good either as your comments are very slanted, almost to the point of crossing the line of the disinformation flormula of 90% truth and then 10% of devastating agenda you build in.

No way. The only thing that might make McCain a NBC is if he was born in a US territory, and that is iffy.

If you think McCain could have been born anywhere and still been a natural born US citizen, then you got to believe that someone can be a natural born citizen of multiple nations. That would be a mockery of our Constitution.

The first time this lie of his came to my attention was when he apparently completed his Illinois Bar Application falsely, by claiming he'd never been known by any other names. I dont think that allegation has ever been debunked. It just shows what an a COMPLETE FRAUD this MF'er is and always has been.

That the treasonous MSM never mentioned this, as well as many other issues that would reveal what an anti-American, lying scounderel this guy is is infuriating!

The level of fraud and concealment by him and the complicit MSM verifies that we, the American People, are being taken for a ride on the Highway to Communist Hell, and history will eventually show this tragic chapter of American political history. But it may be too late for us by the time the unabashed truth finally comes out, just as it was too late for the millions of people who were murdered in the 20th Century at the hands of communist or socialist dictatorships.

Just elated in the sense that I have much more confidence in Kreep than Taitz, who is clearly inept even if her intentions are good.

Never underestimate the ability of Orly Taitz to screw it up. What she does impacts the case as a whole, and the judge can't dismiss her half without dismissing Gary Kreep's plaintiffs as well.

I think we should all be thankful for Judge Carter since a judge less interested in the truth could have easily tossed this case out earlier without pretty much telling Taitz how to do her job.

But as he pointed out, doing so would just delay things since she could turn around and file it again...and again and again until she finally stopped screwing it up.

I believe that a serious jurist would want the case to be so completely solid that it would answer all similar and pending challenges of Constitutional eligibility.

Makes sense to me. My impression is that no judge likes to have his rulings overturned; whether ego or integrity, most judges want their very-public record to make them look good. A "serious jurist" wants, I imagine, the same thing, but is motivated by his sense of justice and respect for the law. Perhaps that is what we have in Judge Carter....

Like I said, you are the one that has been crowing like a chinslurp about all the quick dismissals. You must be getting a bit nervous now that carter sounds at least semi interested in some resolution.

And with you head stuck that far up your but it's easy to see how you could misinform and exaggerate. In every case where the judge granted the defense's motion to dismiss, the plaintiff had a chance to respond to the motion first. As I noted, Judge Carter is familiar with the process even if you and Orly aren't.

Of course he could very well grant the DOJ and Perkins Coie’s circular arguments about standing. Or he could be a patriot as his Marine background suggests.

It would depend if he does his job or, as you would prefer, he doesn't.

Hope springs eternal. Many, if not all of us remember the slow motion train wreck that was the 4 years of Carter incompetence and malfeasance, but what should be frightening the Hell out of every American is to dwell upon the fact that Jimmy Carter, as much of a buffoon as he was, actually had MORE experience when he was sworn into Office in January 1977, than the Dear Comrade had, or has right now.

Author Nathan Miller wrote "Electing Jimmy Carter president was as close as the American people have ever come to picking a name out of the phone book and giving him the job"

But in the case of Barack Hussein 0bama, it was a Kenyan phone book and nobody knew WTF was going to happen.
