No word on whether they’ll be prosecuting any ACORN people for conspiring to cover up sex slavery. They’ve got bigger fish to fry, I guess. Like … the people who exposed the people who conspired to cover up sex slavery.

Ok, I am curious, does an agency conducting public business have a reasonable expectation of privacy? And what about dash cams on cop cars, complete with audio. Do they do that in Maryland? I mean, the cop knows its there but the perp hasn’t given permission yet we see that on the web all the time.

Just wondering.

IMHO because ACORN is funded with so much of our taxpayer money, it would seem to me that it’s a public facility. And, like sidewalks and other public places, anybody ought to be able to walk in there and tape conversations and instructions that these non-professional, non-experts are dishing out.

Maryland needs to give itself a good flush to wash away the communist poo.

No surprise here. Maryland indicted Linda Tripp under the same law, under the encouragement of most of the Rat’s State legislators. I’m no lawyer, doubtless many Freeper legal eagles will better recall the issues raised in Tripp’s case. Fortunately Monica was a flawed witness in some way and they had to back out but IIRC the letter of the law was against Tripp and would be against O’Keefe. O’Keefe may have a 1st amendment Freedom of the Press defense card which Tripp lacked, but if I were him I’d be tracking down conservative legal support institutions.

I believe Linda Tripp recorded phone calls. Which would come under wiretap laws. As far as I know, none of Acorns phones were tapped, and their rooms were not bugged. Only recorded on the journalists cameras.

Judge Napolitano said the law only applied to phone conversations. I don’t know about video. When googling I saw another reference to a situation and it seemed like it was okay because there was no audio.

So maybe the audio is the problem in Maryland.

They really need to drop this before they look like total morons. This is a prime example of a frivolous law suit. Will it save face? No! Will it prove anything? No. Will it diprove anything ? No. Is it an effort to intimidate the public? Yes. In every good Dictatorship, the people must know their place.

Thanks for the correction. I do recall that the general notion that if someone is unaware that they’re being recorded is what is against Maryland law. That’s why the convenience stores post notices at the door that actions are being recorded by video and audio tape.

Excellent! Make residents ashamed of their state. Hammer it as a haven for child prostitution rings. Perhaps some Democrats who want to turn a blind eye for political reasons won’t be so apt to do so when their state is denigrated in such a manner.

Maryland is one of only eleven states where you may not video or audio record a conversation absent the permission of the people involved.

That being said, where can I donate to the legal defense fund?

“I were him I’d be tracking down conservative legal support institutions.”

Yup. I have a hunch he will need them. And ACORN has almost unlimited funds to use for attorney fees. If O`Keefe has more videos, I`m wondering if the authorities can prevent him from releasing them.

This law is the reason your broker and financial advisor now tell you that your phone call with them is recorded. I used to be an in-house lawyer for a brokerage firm in the 90’s.

They have always recorded phone calls to clients in case someone states that they did not request a trade that went bad. But, in Maryland and ten other states, trial lawyers convinced the states to pass the law requiring permission or knowledge of both parties to record a conversation. The other 39 states told them p*ss up a rope.
