I realize journalist (i.e.gossip-mongers) love “off the record” statements because it allows them to extract information easier, and interviewees love it because it lets them vent without consequence. But it’s not like the confessional or doctor-patient confidentiality. It’s a make-believe trust, held together by the parties so long as they think breaking it will come back to hurt them. It certainly doesn’t extend to people who aren’t party to the agreement.

There is an assumption of risk when undertaking to speak out loud in public. ABC has nothing whatsoever to apologize for. It’s not as if they were snooping, or they bugged CNBC’s phones. Obama should have been aware of the possibility that someone could overhear. As for the apology to CNBC, there was no harm done. CNBC wasn’t going to report on it, so you can’t say ABC stole the scoop. It shouldn’t hurt their relationship with the president, either, since they’re not the ones who spilled the beans. You can argue the president may watch his words more carefully in the future around them, but again, they weren’t allowed, by virtue of the sacred trust, to report his off the record comments anyway. So the president tightening his lips shouldn’t matter one way or another.
