Bullshit. This is the sort of thuggish behavior we accuse the other side of. Flag burning isn’t illegal, and attempts to make it illegal just alienate people who might otherwise be sympathetic to the people who hate the little shits who burn our flag.

If you own the flag in question,,no it is not illegal. But he burned a flag that belonged to them,,therefore, it’s illegal as hell. They offered him a chance to siimply be arrested by the police for his crime, or take an alternate punshment they liked.

It was illegal, and they settled on a contract in lieu of prosecution. Simple.

dr, it was not his flag to burn! The flag was someone else’s
property. You just can’t go around mucking up another persons stuff. He got what he deserved.

It was a personal assault, he burned the flag in spite
not for a political statement, he’s quite lucky to
not have it on his record.

Section 135.00 Unlawful imprisonment, kidnapping and custodial interference; definitions of terms

The following definitions are applicable to this article:

1. “Restrain” means to restrict a person’s movements intentionally and unlawfully in such manner as to interfere substantially with his liberty by moving him from one place to another, or by confining him either in the place where the restriction commences or in a place to which he has been moved, without consent and with knowledge that the restriction is unlawful. A person is so moved or confined “without consent” when such is accomplished by (a) physical force, intimidation or deception, or (b) any means whatever, including acquiescence of the victim, if he is a child less than sixteen years old or an incompetent person and the parent, guardian or other person or institution having lawful control or custody of him has not acquiesced in the movement or confinement.

2. “Abduct” means to restrain a person with intent to prevent his liberation by either (a) secreting or holding him in a place where he is not likely to be found, or (b) using or threatening to use deadly physical force.

3. “Relative” means a parent, ancestor, brother, sister, uncle or aunt.

Section 135.05 Unlawful imprisonment in the second degree

A person is guilty of unlawful imprisonment in the second degree when he restrains another person.

Unlawful imprisonment in the second degree is a class A misdemeanor.

True flag burning is not illegal.

BUT this young man committed at least 3 crimes.
Taking VFW property (flag)----------Theft
Buring said property (flag)---------Arson
Not leaving property when asked-----Tresspassing

Now for the young man's punishment. He was given 3 options.
1. Turned over to police----------He turned this down
2. An old fashioned ass-kicking---He turned this down
3. Strapped to the flag pole------He CHOSE this option

Now since the young man chose option 3 (chose to be restrained) you can't really cry "unlawful restraint" because has was given a way not to be restrained.
Also he could have cried out "call police" or "help" while he was restrained since he was not gagged. No this man sat there till his punsihment was over. After he was released could have called the cops, but he accepted his punishment like a man.

It wasn't his flag...NOBODY has any legal right to burn someone elses property, what makes you think they do?

1. Have criminal charges filed against him by the owners of the flag

2. Get his ass whipped by the owner of the flag

3. Duct Tape

he had 3 legitimate choices and he went for #3

Whats wrong with that?

The offender burned a flag that did not belong to him. That is destruction of private property and/or theft and/or vandalism depending on the local laws.

First, the “other side” uses profanity, like your use of the word “bull. . . . .”, we are better than that.

Second, the guy burned a flag that was not his property, therefore he acted illegally.
