NY state senator escapes felony assault conviction

Democratic State Sen. Hiram Monserrate was found not guilty today of the felony assault after Queens Supreme Court Judge William Erlbaum rendered his verdict after reflecting on the evidence.

Monserrate was found guilty of the lesser charge of third-degree assault, a misdemeanor, in the non-jury trial for dragging his girlfriend down a hallway, an incident that was caught on surveillance cameras.

Monserrate, who gets to keep his seat as a result of being acquitted on felony charges, faces up to a year in jail. He will be sentenced Dec. 4.

Monserrate (D-Queens) showed no emotion as the verdict was read.

They keep mentioning he's a democrap. What a weird paper the NYPost is; maybe their circulation will go up, too.

Reading a brief blurb on Justice Erlbaum (http://www.sglawny.com/CM/Articles/Profile-of-the-Hon-William.asp), it's clear he's a typical lib on the bench. The homeless, ACLU, inmate education, etc.

We are to assume that he believed the girlfriend received the cuts on her face not from Monserrate forcibly pushing a glass into her face, but instead from the girlfriend "falling into" the glass as it was held by Monserrate.

And as for Hiram pushing her down the hallway, he was trying to rush her to the hospital but she was reluctant to go.

Yeah, riiiiiiight.

Hiram is scum, a thug, a Queens wife-beater.
As for the judge, surely payoffs etc. were involved as a felony conviction would take Monserrate out of the NY Senate and their Democrat edge becomes precarious.

Don't see Hiram switching parties unless his legal defense was paid for by Roger Stone.
