I am listening to girly man Shep interview the POS's cousin. Stupid steaming pile of a cousing keeps saying over and over that Hassan was a good American. Ummmm, I'd say today's events say otherwise. Seems to me hassan was a Muslim first, whiny wimp second, and good American comes in dead last.

Can we please acknowledge already that islam is the most agressive and malignant cancer facing the world today.

Juxtapose the info above and bold to the FBI statement saying "there is no evidence of terrorism" on the contrary, we have been lied to.

What’s interesting is that in the original interview between the perp’s cousin Natter Hasan and Shep Smith, the cousin said something to the effect that the perp told the family “stories”. The cousin intimated that these “stories” were told to the perp by his patients. Wouldn’t that violate doctor/patient confidentiality, let alone a host of other “stuff”?

I think after the original interview, that part was possibly redacted. See my tag line.

No. It's clearly a federal reservation - federal property. It's complicated and there are some limited circumstances where a murder on a base could be prosecuted under state law, but this case isn't one of those cases. The military will get first crack, then the feds if Obama - and it would be Obama's decision, decides to move it to federal court.

I agree that under military law, the military via Courts Martial has first crack at this POS and can impose the death penalty. But under Federal law, unless he killed a protected Federal official (CIA, FBI, Elected Official etc.) their are no Federal capital offenses involved. Keep in mind that McVeigh was not executed for killing a couple hundred civilians in the State of Oklahoma. He was tried and convicted in Federal Court for killing a handful of protected Federal law enforcement agents.

With my meager knowledge of the law, killing a GI, or a civilian on Federal property, is not a capital offense under Federal law. But murdering anyone, anywhere, in the State of Texas, on Federal property or not, can be a capital offense.

This POS is subject to the USCMJ only because he was a member of the US Military. If he had been a civilian walking on to that base, it would only be the State Courts to impose murder charges.

Yes, you're right about his culpability under the UCMJ. But, given the circumstances of the day, I suspect that this crime falls within the definition of an act of domestic terrorism. And, as such, he would be eligible for the death penalty even in federal court under a number of violations of the US Code found in Title 18, more specifically the Antiterrorism and Effective Death Penalty Act of 1996 - which of course sprang from the criminal horror of the Oklahoma City bombing. That statute was expanded and enhanced with several post-9/11 Acts as well.

Not sure yet. I am going to zero my Zeiss Z-point red dot sight too, which is allowed. It is a co-witness sight that puts a red dot on top of the front sight. I might go naked. My biggest weakness is my glasses...
