Sen. Jeff Merkley (D.-Ore.) says that Congress derived the constitutional authority to make Americans purchase health insurance as part of its "very first enumerated power." He was referring to the language at the beginning of Article 1, Section 8 of the Constitution, which says: "The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States."
CNSNews.com asked Merkley: Specifically where in the Constitution does Congress get its authority to mandate that individuals purchase health care?
Merkley said: The very first enumerated power gives the power to provide for the common defense and the general welfare. So its right on, right on the front end.
Before CNSNews.com could ask a follow-up question, Merkleys press secretary pulled him away, apparently to attend an event.

collect Taxes, Duties, Imposts and Excises,
....................
So they are using the HCR as a ruse to raise taxes on all Americans.
Then they better call it what it is.
A GIANT TAX.
He just stated that it is not a “deficit” neutral bill.
IT IS A TAX BILL.

Merkley is a first termer. He needs to be thrown out of office with all the hospital waste!
I always read that as common defence and general welfare of the US as a political entity, not as a free pass to redistribute. Boy have I missed the boat.
Even more amazing is the fact that some people will hear him say that, and believe it. Our schools have been horribly remiss in teaching kids about our Constitution. I believe this is on purpose.

So now the Dems are saying that this is just another tax increase??
So, why did we need the 16th Amendment then? His reading of the document gave the Feds complete power from the outset. After all, what is NOT related to the general welfare?
By his own admission then, the Congress must pay the same Duty, Impost and Excises as anyone else - including this health tax?
As a complete foreigner - I thought the language “United States” in the Constitution referred only to the Federal Government?
Oh and also, all progressive taxation is apparently ruled out by the first lines of the Constitution? What does the Senator think about that?
When Free America is formed from the split of the US, the restored constitution will not have the General Welfare language, nor will it have the Interstate Commerce regulation, nor will it have the part about well regulated militias in the 2nd AMendment, nor will it have the anchor baby clause in the 14th amendment, etc.
New Democrat talking points; Sen. Burris said the same thing
If Sen. Merkeley is correct——and he isnt——— pretty much anything the Senator and his fellow buttwipes in the Senate decided was in our common welfare, we could be forced to buy.Up to and including a new Chevy.
D-orky Merkley. Love the image.
There needs to be a big SMACK down of these people.
Can’t the Supreme Court do that? Unconstitutional is
Unconstitutional!
“Provide for the general welfare” is no more a “power” than “paying the debts” is a “power.”
Have another sandwich Merk
It only refers to that when they find it convenient, otherwise it refers to every individual in the United States.
If this scumbucket has this as his excuse for tyranny, you can bet the same talking point has been implanted into every democrat, probably from Axelgreasy’s desk by way of a Rahm memo to all democrat soldiers in the legislature.
