Tough situation. Is the punchee supposed to let the puncher keep hitting him until he cannot defend himself and maybe be killed as a result?

And from the other end, once you’ve initiated violence and failed to put your opponent down, you kind of open yourself up to whatever he chooses to do.

If all you have is a steak knife, everything looks like ribeye.

There is a lot missing here.

It is not OK to stab someone over a seat, but if you had read the black print on the white screen you would have seen that the seat-hogger also punched the guy who asked him to move his stuff. Now, if someone punches me, and has the demeanor that he is going to keep on punching, I have the right to defend myself.

Depending on his age, relative size, and physical condition, I may very well be in fear of my life or of great bodily harm from his attack. This is the criteria for armed self defense in rational states and places.

The outcome of this really depends on the statements made by the stabber. If he tells the cops "He was an A-hole and really needed stabbing." he is going to jail for a long time. If he says: "I was in fear of my life, and I want a lawyer." he may walk.

LOL I used to work at a homeless shelter. I have been in more fistfights with homeless people than you've had hot meals.

Beating homeless people with your fists? You're proud of that? You ought to be trotting in jail. You're a vicious, uncaring animal.

thats not true. i know it makes many feel good to think so but i’ve lived here most of my 55 years and i can tell you from first hand experience there were many many more polite courteous people living here during my life time.

The guy clearly overreacted. He’s about to find that out courtesy of the criminal justice system. But it’s not murder.

Yeah, I know how it is in NYC—the other guy didn’t sound like an Eagle Scout either.

You’re dead on about the gun BS—besides I saw a couple stats—98% of gun murders in NYC is done by blacks/Latinos—In LA non Hispanic whites account for less than 5% of murders done by any method.

The most accurate term of what we suffer—more so than “gun crime”, is “nonwhite crime” or, increasingly, “nonwhite/Muslim crime”

Before you make such stupid statements, ask the facts first. I've been in fights because I've been ATTACKED by homeless people. It happens sometimes when you choose to work a job with little pay because you are helping folks who need it--I guess you wouldn't know about that, while you call people "uncaring".

Of course someone has the right to defend himself, that's never been a question. I just don't see how we get from that to killing him.

I saw the picture of the murderer on the front of the Post in the store a few minutes ago, and I'll just say this--if his picture accompanied the story as posted here, the responses would have been very different.

Both of them are filth. One is dead, one is in jail.

That’s life in the big city.

They both had a chip on their shoulders trying to be real macho men, some kind of Hollywood movie tough guys.

he locked the doors to get out of the train. the passengers would be able to move to another train car through the interior doors.

you’ve obvioulsy never been in a NYC subway car. so please keep those types of comments to yourself. the other passengers were not locked in the subway car with the killer.

but I would have just gotten angry and said something mean instead of killing the man. I would maybe come up with something like “your breath stinks,” just to make him a little self conscious about it for the rest of the day.

... you didn't grow up in a bad neighborhood. I don't know, I don't "fight" for anything where I was from unless I wanted to fight. Homeless people are psych patients off meds, drunks or drug addicts. You mess with them at your own risk.

Since the man couldn't carry a weapon, a knife is a good substitute and as is evident, can just about do the job of "self defense".

Using a knife is just nasty, cause you have to get up close and personal. Pistols let you have that stand off and create a bigger bubble for you.

Of course your mileage may vary...
