If you read one of the linked article's JK says his daughter was not legally drunk. This one of the problems when you have a state with too many lawyers. If an officer can testify as to driving and SFT’s along with a BAC of say .04, .05, etc, that should be a conviction. California has the per se .08; but, it also DUI. Aw, poor California so many lawyers, so little common sense.

As I recall, she was under the legal limit and with that fact, the prosecutors have no choice but to drop the charges. Not so in California, the legal limit is a presumptive limit where the law must assume her to be impaired. Anytime you can prove impairment no matter the alcohol blood leave the DA can prosecute.
