As we reported in last week’s Grassroots Alert, on December 10, the U.S. House of Representatives approved an NRA-backed amendment, introduced by U.S. Senator Roger Wicker (R-Miss.), to allow Amtrak travelers to transport firearms in checked baggage where checked baggage service is available. The Wicker amendment was included along with several government agencies’ appropriations bills in the Consolidated Appropriations Act of 2010.

The Firearms Owners’ Protection Act protects law-abiding gun owners from local interference when traveling by car, and the Transportation Security Administration has rules for transporting guns in checked baggage for those traveling by air. But for nearly a decade, those who travel by train have been prohibited from bringing firearms on board Amtrak. The Wicker Amendment will fix that problem.

A modified version of the amendment was included as one of the six appropriations bills considered as an omnibus spending package. The measure was passed by both houses of Congress and was signed into law on Wednesday, December 16.

Folks, keep this in mind -

they can’t get everyone at once on the first “wave” of either roundups or confiscations.

The second wave will have quite a bit more trouble than the first.

And those who sent the waves will start seeing some trouble of their own at that point.

Is it even a law? If the bill passed by the House and Senate is not the same then can it be law.

While we all laugh at these Jackasses in Washington they are having the last laugh..

Am I missing something? Doesn’t this mean there are still no legal practical provisions for carrying a firearm on a Train for the next year or so?

I found its HR 1105 but I am having a problem finding the amendment number. It was sponsored by Rodger Kicker but all references so far have no number just the intent of the amendment. My goal is to find the bad wording in the bill.

A good example of why it is important that EVERY bill be read into the Congressional Record - everyone knows what it is that is being voted on, word-for-word.

The health-care bill is a prime upcoming candidate for such clarity. Start reading, Mr. Congressman - should only take about 50 hours to get thru it.

Ok here is what I believe this article is about and I must be missing something in the wording but I do not see the miss wording.

S 1638 IS

SEC. 3. SECURE TRANSPORTATION OF FIREARMS ON PASSENGER TRAINS.

Section 24305 of title 49, United States Code, is amended by adding at the end the following:

`(g) Secure Transportation of Firearms- If an Amtrak station accepts checked baggage for a specific Amtrak route, an Amtrak passenger holding a ticket for such route shall be allowed to place an unloaded firearm or starter pistol in a checked bag on such route if—

`(1) before checking the bag or boarding the train, the passenger declares to Amtrak, either orally or in writing, that the firearm is in his or her bag and is unloaded;

`(2) the firearm is carried in a hard-sided container;

`(3) such container is locked; and

`(4) only the passenger has the key or combination for such container.

`(h) Small Arms Ammunition- An Amtrak passenger shall be allowed to place small arms ammunition for personal use in a checked bag on an Amtrak route if the ammunition is securely packed—
`(1) in fiber, wood, or metal boxes; or

`(2) in other packaging specifically designed to carry small amounts of ammunition.

`(i) Applicability- Subsections (g) and (h) shall not apply in any fiscal year in which Amtrak does not receive Federal financial assistance.’.

What am I missing?
