The only shock to me is that we haven’t heard of someone using this defense earlier.

I’ve been thinking about do it so I can get free health care and food stamps and all the other ‘goodies’ illegals can get and not pay for!
1. Free medical care at emergency rooms
2. In state tuition
3. Fly under the radar of the IRS and avoid taxes
4. No ID or proof of insurance if involved in a collision
5. Receive a NINJA loan and then walk away after months/years of no payments with no repercussions

Criminals do tend to be stupid. The state prisons in California and Arizona and God knows how many other states are filled with inmates who were here illegally when they were arrested. Illegal or not, he would have been extradited, tried for the attempted murder charge, jailed and then, if he got out, deported.
It might have worked too.
Maybe they have and we don’t know about it because it was successful.
I think it’s been done before, especially for legal immigrants who claim to be illegal or Americans who speak with a solid Mexican accent. This is probably just the first guy who claimed being illegal who was caught on the fraud, because it’s murder, not drunken driving or a “minor” charge.
Believe me, the thought of using this defense if I get pulled over has crossed my mind. But it probably wouldn’t work because I’m not swarthy enough.

You don’t even need to fake a poor accent. Just claim to the child of illegal immigrants who grew up here in the US. Then you can get lower college tuition among other goodies.
6. Get away with murder
That strategy of claiming you are an illegal alien and hoping to be deported instead of being sent to prison is not just one to be used to get out of trouble in the first place. The idea has been floated around in Nevada (and I am sure other states) as a means of dealing with prison overcrowding. The idea calls for releasing illegal aliens back to Mexico. (Where they would of course be free to cross back over the border and return to commit even more crimes. Never mind, of course, that it would set up a two tier system with American citizens serving the time for their crimes while the Mexicans get out of jail free.) The plan is sheer idiocy, but what can I say? We have some certifiable idiots running things in our state.
Why not? Illegals have more rights than Americans. I’m surprised Americans haven’t started going to Mexico, sneaking back in across the border, and just living as illegals. I’m half tempted to do it myself. I’m tired of paying taxes and paying for auto and health insurance. I’m sick of being a chump.
