Justice Department sues swim club

The U.S. Department of Justice filed suit Wednesday against a Lower Moreland swim club accused of ousting black and Hispanic day campers this summer because of their race.

The children of the Northeast Philadelphia-based Creative Steps day camp were denied rights protected under the Civil Rights Act of 1964 when, after one visit, they were refunded the rest of their summer-long pool fees and asked not to return, the filing said. The club created a new policy against admitting any more day camps “in response to racially-motivated opposition from Valley Club members to Creative Steps.”

The lawsuit seeks to bar the club from doing anything similar in the future, said Department of Justice spokesman Alejandro Miyar. The filing asks that the club’s discriminatory policies and practices be declared a violation of Title II of the Civil Rights Act and that the club and its associates be kept from denying those rights in the future.

OK, I still think you're not getting where I'm coming from. For the first couple hundred years of the "republic", people realized that you could run a business, if you paid your own expenses, without giving up the freedom to decide with whom you would choose to associate. In this case, to do business with. This allowed misguided racists and businessmen with racist customers to choose to make that choice contingent on skin color. Not right, what they're doing, but also none of the government's business to regulate.

Just because something is right, doesn't mean the government as defined in the Constitution (Obama's Toilet Paper (tm)) has the power to enforce it. I think a black guy who doesn't like whites has every right to open a business and refuse to serve whites if he wants. Since corporations are creatures of the government in the first place, I might see more restrictive rules for corporate entites, especially publicly traded ones.

And even then, I've seen no evidence that this particular issue was racially motivated. I'm talking in the abstract about government regulation of racial discrimination by private businesses.

Let me know how that works out for you. And don’t forget to carry a lot of liability insurance. You won’t be able to claim your pool is “private” when you’re sued.

Wrong. I let a friend use my pool for a day and he gives me some money for it. My home insurance and the fence around the pool covers liability from injuries. The only people allowed to use my pool are the people I say can use it, meaning my friends.

Thank God the JD freed up those prosecutors who had been working on the Panther indimidation case. Now they can focus on way more important cases......

That is what I remember from the story. They were noisey, ill behaved, etc. But of course it had to be because they were black it couldn’t be because they were brats! Hopefully someone had a video camera handy recording their actions?

I do become highly dubious when the Justice Department sues anyone

This is the same Barack Obama Injustice Department that protects the Black Panthers from prosecution of voter intimidation laws.

“But it’s not private. It offered the use of its pool, and took cash. “

This is pretty much the definition of Private.

And how do you think your insurance carrier will feel about you renting your pool? Do you think it might have liked to know in advance when it wrote up your policy?

Dur, that’s pretty much the definition of Public, if you wish to pick and choose definitions.

““But it’s not private. It offered the use of its pool, and took cash. “

It offered the use of the pool for money. If it didn’t offer it, the people couldn’t swim. Thus, it is private, not public.

Do you even understand that you are arguing semantics? The club is a private entity offering its services to the public.

“The club is a private entity offering its services to the public.”

Who else would any private org. offer its services to?
