Police: Illegal immigrant raped 76-year-old

UMATILLA - A 76-year-old grandmother is in stable condition after she was allegedly raped by a man that had been tasked with her supervision.

A Marion County Sheriff's Office spokeswoman said the woman is in the hospital awaiting surgery.

Juan Cahuich-Santiago, 29, was charged Tuesday with sexual battery on a special condition victim. The illegal immigrant was being held at the Marion County Jail on Wednesday on no bail.

The alleged attack occurred Saturday, late afternoon or early evening, in a Umatilla area home in east Marion County where Cahuich-Santiago lived with the victim and her family. The victim is unrelated to Cahuich-Santiago.

According to the sheriff's spokeswoman Jenifer Fisher, the woman's family was grocery shopping and she had been left under Cahuich-Santiago's supervision.

When the family returned, they found Cahuich-Santiago sleeping and the grandmother lying sideways on a recliner with her clothing not fitting properly.

According to an arrest affidavit, the victim had a bump on her forehead, bruises on her knees and her pony tail was pulled out. The woman could not stand at that time, which she could before the family left for groceries.

And, a used condom was found in the garbage.

"It is a piece of evidence but DNA testing takes four to six weeks so we cannot absolutely confirm it was used by him or on her at this time," Fisher said.

Cahuich-Santiago initially denied attacking the woman, but later confessed that while alone with the victim, he had been watching dirty movies, before approaching her. The report adds he admitted that the victim is incapable of saying no, and is unaware of her surroundings.

He said he placed her back in the recliner when he was done.

Santiago is in the country illegally, but Fisher said any effort to deport him wouldn't start until after he is tried here for this crime.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Sonoita, Arizona. Records checks revealed the subject had a prior conviction for sexual assault in the State of Arizona and had been previously removed from the United States.

Del Rio Sector - Border Patrol agents arrested an illegal alien from Mexico near Brackettville, Texas. During processing, the subject admitted to being a Tango Blast gang member. Records checks revealed he had also been previously removed from the United States.

Del Rio Sector - Border Patrol agents arrested a United States Citizen (USC) and recovered two rifles and a shotgun near Asherton, Texas. Agents apprehended the subject shortly after he allegedly burglarized a home. During processing, the subject admitted to being a Mexican Mafia gang member. Records checks revealed he had active arrest warrants for parole violation and burglary in the State of Texas.

Marfa Sector - Border Patrol agents detained a USC and seized a small amount of marijuana near Sierra Blanca, Texas. The subject presented himself for inspection and a Border Patrol canine alerted to his vehicle. A search of the vehicle revealed the narcotics as well as a 9 mm Smith and Wesson handgun.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Nogales, Arizona. The subject claimed he was assaulted by a bandit in Mexico prior to entering the United States. He was transported to a local medical facility for treatment and subsequently released into Border Patrol custody.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Nogales, Arizona. Records checks revealed the subject had a prior conviction for lewd or lascivious acts with a child in the State of California, and had been previously removed from the United States.

Tucson Sector - Border Patrol agents arrested a USC near Nogales, Arizona. Records checks revealed he was the subject of an active extraditable warrant for first degree murder in the State of Arizona.

El Centro Sector - Border Patrol agents arrested an illegal alien from Mexico near El Centro, California. Records checks revealed the subject had a prior conviction for assault to commit mayhem/rape in the State of California and had been previously removed from the United States.

Rio Grande Valley Sector - Border Patrol agents arrested six illegal aliens from Mexico and seized 1,522 pounds of marijuana near Hidalgo, Texas. Agents encountered several subjects carrying the suspected narcotics, who then attempted to abscond into the brush after seeing the agents. A total of 62 bundles were recovered.

Rio Grande Valley Sector - Border Patrol agents seized 1,166 pounds of marijuana and a 1995 GMC Suburban near Rio Grande City, Texas. Agents observed the vehicle being loaded with contraband and deployed a Controlled Tire Deflation Device as the driver attempted to abscond. The driver of the Suburban fled the scene and was not located.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Ajo, Arizona. Records checks revealed the subject had an active arrest warrant for lewd or lascivious acts with a child under 14 in the State of California, and had also been previously removed from the United States.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Ajo, Arizona. Records checks revealed the subject had a prior conviction for disorderly conduct to solicit lewd acts in the State of California and had been previously removed from the United States.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Tucson, Arizona. Records checks revealed the subject had an extensive criminal history, to include a prior conviction for sex with a minor in the State of California. He had also been previously removed from the United States.

The subject appeared to be suffering from hypothermia and was transported to a local hospital where he was treated and released into Border Patrol custody. During processing, he admitted to being a Paisas gang member, and records checks revealed he had been previously removed from the United States.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Douglas, Arizona. Records checks revealed the subject had a prior conviction for rape of a minor in the State of California and had been previously removed from the United States.

Marfa Sector - A Border Patrol agent was injured after being dragged by a car leaving secondary inspection at the traffic checkpoint near Sierra Blanca, Texas. Two USCs were being inspected when they abruptly drove away from the checkpoint. The agent was dragged by the vehicle for a short distance. Agents immediately followed the vehicle, performed a vehicle stop and took both subjects into custody.

While evading arrest, the subject struck an agent's Border Patrol vehicle, and then subsequently crashed his vehicle in the desert. He attempted to abscond and was arrested without further incident.

Marfa Sector - Border Patrol agents seized 174 pounds of marijuana and a 1989 Chevrolet Blazer near Marathon, Texas. An agent initiated a vehicle stop and the driver failed to yield. The vehicle eventually came to a stop and the occupants absconded into Mexico. A search of the vehicle revealed six backpacks with the narcotics inside.

Tucson Sector - Border Patrol agents arrested an illegal alien from Mexico near Arivaca, Arizona. Records checks revealed the subject had a prior conviction for aggravated criminal sexual abuse in the State of Illinois, and had been previously removed from the United States.

Illegal immigrant makes bail; feds send him home to Guatemala

Defense and prosecution were ready for Genesis Orrego’s arraignment on child rape in superior court. Orrego was charged with molesting a 10-year-old neighbor his girlfriend often babysat in Weymouth.

But Orrego, who faced charges of rape of a child with force and indecent assault and battery of a child under 14, wasn’t there. He was in federal custody, and the following week he was deported to his native Guatemala. He had been freed on $10,000 bail on the local charge, turned over to the U.S. Immigration and Customs Enforcement and they were doing their job – deporting him out of the country.

Norfolk County prosecutors knew Orrego, also identified in court as Genesis Orrego Gonzales, was in the country illegally, and said at his earlier arraignment in district court that ICE had placed a detainer on him. Orrego told police he had been in the U.S. for more than 10 years after walking for four months from Guatemala to Texas.

When he made his $10,000 bail, which prosecutors had requested be $100,000, he was transferred into ICE custody on July 27, according to immigration officials.

The Norfolk County District Attorney’s office expected him at his arraignment in superior court in Dedham on Sept. 24 after being indicted by a grand jury. Spokesman David Traub said the district attorney’s office was in contact with ICE and filed paperwork to make Orrego available for the Sept. 24 arraignment. They found out that wasn’t the case that day.

“It was his ability to meet the $10,000 bail that put him into ICE custody,” Traub said.

ICE cannot hold a person for another agency, whether they’re awaiting trial or not, spokesman Paula Grenier said.

“Our congressional mandate is to enforce the immigration custody laws on the books on the United States,” Grenier said. “ICE does not have the discretion to hold for another agency.”

Should Orrego come back into the U.S. again, he will have a superior court indictment and default warrant out of Quincy District Court awaiting him. But it’s not a given that he won’t re-enter the country again undetected.

While a local agency can file a request through ICE to have an alien transferred back into state custody, in Orrego’s case there was no state custody for him to be brought back into because he was out on bail.

Prosecutors can argue at arraignment that an immigrant with ties outside the country is a flight risk.

On Mexicans by a California teachers:

I am in charge of the English-as-a-second-language department at a large southern California high school which is designated a Title 1 school, meaning that its student’s average lowers socioeconomic and income levels. Most of the schools you are hearing about, South Gate High, Bell Gardens, Huntington Park, etc., where these students are protesting, are also Title 1 schools.

Title 1 schools are on the free breakfast and free lunch program. When I say free breakfast, I'm not talking a glass of milk and roll - but a full breakfast and cereal bar with fruits and juices that would make a Marriott proud. The waste of this food is monumental, with trays and trays of it being dumped in the trash uneaten. (OUR TAX DOLLARS AT WORK)

I estimate that well over 50% of these students are obese or at least moderately overweight. About 75% or more DO have cell phones. The school also provides day care centers for the unwed teenage pregnant girls (some as young as 13) so they can attend class without the inconvenience of having to arrange for babysitters or having family watch their kids. (OUR TAX DOLLARS AT WORK)

I was ordered to spend $700,000 on my department or risk losing funding for the upcoming year even though there was little need for anything; my budget was already substantial.. I ended up buying new computers for the computer learning center, half of which, one month later, have been carved with graffiti by the appreciative students who obviously feel humbled and grateful to have a free education in America. (OUR TAX DOLLARS AT WORK)

I have had to intervene several times for young and substitute teachers whose classes consist of many illegal immigrant students here in the country less then 3 months who raised so much hell with the female teachers, calling them "Putas" whores and throwing things that the teachers were in tears.

Free medical, free education, free food, day care etc., etc, etc. Is it any wonder they feel entitled to not only be in this country but to demand rights, privileges and entitlements?

To those who want to point out how much these illegal immigrants contribute to our society because they LIKE their gardener and housekeeper and they like to pay less for tomatoes: spend some time in the real world of illegal immigration and see the TRUE costs.

Higher insurance, medical facilities closing, higher medical costs, more crime, lower standards of education in our schools, overcrowding, new diseases etc., etc., etc. For me, I'll pay more for tomatoes.

We need to wake up. The guest worker program will be a disaster because we won't have the guts to enforce it. Does anyone in their right mind really think they will voluntarily leave and return?

There are many hardworking Hispanic/American citizens that contribute to our country and many that I consider my true friends. We should encourage and accept those Hispanics who have done it the right and legal way.

It does, however, have everything to do with culture: A third- world culture that does not value education, that accepts children getting pregnant and dropping out of school by 15 and that refuses to assimilate, and an American culture that has become so weak and worried about "politically correctness" that we don't have the will to do anything about it.

If this makes your blood boil, as it did mine, forward this to everyone you know.

CHEAP LABOR? Isn’t that what the whole immigration issue is about?

Business doesn't want to pay a decent wage.

Consumers don't want expensive produce.

Government will tell you Americans don't want the jobs.

But the bottom line is cheap labor. The phrase "cheap labor" is a myth, a farce, and a lie. There is no such thing as "cheap labor."

Take, for example, an illegal alien with a wife and five children. He takes a job for $5.00 or $6.00/hour. At that wage, with six dependents, he pays no income tax, yet at the end of the year, if he files an Income Tax Return, he gets an "earned income credit" of up to $3,200 free.

He qualifies for Section 8 housing and subsidized rent.

He qualifies for food stamps.

He qualifies for free (no deductible, no co-pay) health care.

His children get free breakfasts and lunches at school.

He requires bilingual teachers and books.

He qualifies for relief from high energy bills.

If they are or become, aged, blind or disabled, they qualify for SSI. Once qualified for SSI they can qualify for Medicare. All of this is at (our) taxpayer's expense.

He doesn't worry about car insurance, life insurance, or homeowners insurance.

Taxpayers provide Spanish language signs, bulletins and printed material.

He and his family receive the equivalent of $20.00 to $30.00/hour in benefits.

Working Americans are lucky to have $5.00 or $6.00/hour left after paying their bills and his.

The American taxpayers also pay for increased crime, graffiti and trash clean-up.

Cheap labor? YEAH RIGHT! Wake up people.
