In what amounts to a political street fight, the Senate Republican minority has pushed Obama hard in its rebuke of the nomination of Craig Becker. Becker, a pro-labor nominee to the NRLB, saw his nomination come to a screeching halt last Tuesday. Republicans, joined by conservative Democrats, defeated an effort to allow the nomination process to move forward. Now the administration is pushing back, indicating a willingness to consider a recess appointment to place Becker at the NRLB and bypass a Senate confirmation vote.

Given the fact that Bush did this himself, its probably not a real strong argument.
However, recess appointments can be eliminated at the start of the next legislative session if we have the votes.
I’m not happy that Obama wants to do this. However, Bush made some recess appointments too. And the constitution provides explicitly for recess appointments. So while we’re not happy that he wants to do it, it’s not “unconstitional” that he wants to do it.
I believe John Bolton was a recess appointment.
A rare occasion he may follow the constitution otherwise he will trash it.

Can’t the Senate GOP prevent the recess appointments by staying in DC and claim to be ‘in session’? I thought this was done before to GWB.
Yes, but this is coming from someone who campaigned as the most “open, honest and transparent” administration ever.
Recess appointments are a blatant bypassing of the standard process.
So much for “open, honest and transparent.” This is quickly proving to be the most covert, corrupt and back-room driven administration since the Grant administration.

Harry Reid, leading the Senate's new Democratic majority, is framing next year's schedule in a way that will make it difficult, if not impossible, for President Bush to give recess appointments to nominees blocked for confirmation. Reid's schedule limits Senate recesses to one week. Recess appointments usually are made only when Congress has been out of session for at least 10 days. That may kill any consideration of trying to seat federal appeals court judges whose nominations had been stalled even in the Republican-controlled Senate. The downside may be a rebellion by senators if their breaks are held to one week.
As to legality, refer to Article II, Section 2 of the U.S. Constitution: "The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."

Well, I separate things out into different issues and the various issues stand on their own. As far as this issue is concerned (which would be recess appointments), I can’t see the big deal about it. We’ve held up their appointments and they’ve held up our. We’ve done recess appointments and they’ve done recess appointments...

of more concern is the obama admin’s activity to bypass congress on any number of issues by abusing executive power and probably any unconstitutional means they can get away with.
Bush's recess appointments were unconstitutional, meant to thwart the will of the elected Senate. Obama's recess appointments are constitutional, and necessary to get around an unconstitutionally stonewalling Senate.
Slight difference...when the donkeys did it to Bush, the donkeys were in the majority...unless there is some objection to recess that the GOP can use (I don't know the rule), they can't stop recess.
