Traffic safety is typically the reason given by municipal or state legislative leaders when there is a consideration to ban the use of cell phones and texting while driving. The NCS announced in January that it estimates approximately 28 percent of all traffic crashes – or at least 1.6 million crashes each year – are caused by drivers using cell phones and texting.”

I do a lot of work in areas that involve traffic safety, and I am adamantly opposed to this kind of legislation.

Any safety-related concerns about cell phone use while driving can be addressed through existing motor vehicle statutes related to careless or reckless driving. This is nothing more than "feel-good" nonsense aimed at raising revenue for local governments.

If someone is driving erratically on a public road in front of me, they could be -- and should be -- dealt with under existing laws. It doesn't matter if they are driving this way because they are sending a text message, they are 105 years old and have no business behind the wheel, or they are simply retarded.

I was at a busy intersection a while back when I noticed a woman in a Suburban stop almost halfway out into the intersection. Rather than back up (she had the room) she continued to just sit there while others had to go around her.

And what was she doing that was so important that she couldn’t be bothered with simple courtesy?

Talking on a cell phone.

I'm in New Jersey which already made cell phone use while driving illegal.

Of course waking up in NJ is also illegal.

Do we really need more unenforceable laws? It is illegal to drive with out a license, but I dare say a good number of the drivers on the road are driving without one. I read the police reports in our local paper, every week there is five or six people getting a second or third DUI, many of them are driving without a license.

I don't see a way to enforce a cell phone ban in the first place. Prove I was talking on my phone.

Shouldn’t be distracted with an annoying passenger like a whinny person saying “we are lost”, “you are driving to fast” (always cracks me as I watch cars go flying by), “Why don’t you just pass this idiot and why are you in the slow lane. Don’t you know how to drive? (Cracks me up again, from the same person who complained about driving to fast.)

“Etcetera, etcetera, etcetera”

Shouldn’t be distracted with kids in the car. Leave them home.

All wipers should be federal mandated to have laser on them so they wipe as needed and you don’t have to figure out what speed to put them on or where the “turn on switch thing is”.

No cute toys or ornaments any where near the front window, on the dashboard or hanging from a mirror. (Sorry bobble head Chihuahua)

No cute toys or ornaments any where near the back window, on the deck or stickers. (Again, sorry bobble head Chihuahua)

No stickers on the side windows (impairs your view)

No dry cleaning hanging from anywhere in the car. Makes noise and impairs your view.

No ashtray, no smoking, no eating and drinking anything in the car (you should have both hands on the wheel at all times, in the 10 and 2 O’clock positions.

No putting on lipstick or make up ever and no shaving.

No more vanity mirrors, you shouldn’t be looking at anything but the road.

No pets ever. Never know what they are going to do.

Exceptions:

Police -
3 to 5 radio channels transmitting information all the time, computer sending info all the time, GPS sending info all the time, they can talk on radio and switch to secure channels, Cell phone use is frequent.

They do have drinks in car; have to look at license plates as they travel down the road, look for people in distress, look for crime, look for infractions, etc.

Truck Drivers -
CB is allowed, GPS is allowed, and Radio is allowed, pets in the front seat or back of cab, lunch, dinner and snacks. Cooler for their drinks and yes drinks, Cell phone, a bunch more dials of information to ensure the truck and trailer are running correctly.

 

Airline Pilots -
Just look at all that crap in the cockpit! How do they do it?

There is no such thing as a General Welfare Clause in the Constitution, except for the 17 enumerated powers contained within.

It’s a State issue.

They would have to start from Common Sense as cogent activity.

So no, they cannot legislate common sense but, they can do a lot of nonsense.

No. But increase the penalty for causing an accident if you are. “Attempted vehicular homicide” sounds about right.

Definitely, but I doubt that any law will be enforced very well. Most likely it will result in just an additional charge piled on after an accident, etc.

It is enforceable as the activity is visibly measurable in nature. Same as Speeding, which not even in the top five of causes for why an accident takes place. It is, however, a contributing cause the the severity of damage from ramming 2,500 pounds of metal into anything EMC

I almost was run off the road yesterday. In broad daylight. By a woman. With both hands on the wheel. She had to have been in her late 70's or early 80's.

No texting and a bigger menace on the roads than a cell phone ever could be.

I see that you’ve never had someone swerve at you at 75 MPH while talking on a cell phone. Using a bluetooth isn’t that hard.

I travel all over TN on business so I see all types of drivers, while I agree that texting should be banned I disagree about talking on the phone. Pulling to the side of the interstate to talk and then merging back on the road would cause more wrecks than are seen now. So if you don’t want to talk on your phone while driving don’t: but you should also stop eating in your car,drinking coffee or anything else that might distract you.
