CA: "Family Values" Senator Ashburn Gets DUI Leaving Gay Bar

SACRAMENTO -- The county district attorney says Republican state Sen. Roy Ashburn's blood-alcohol level was .14 percent when he was arrested on suspicion of drunken driving after leaving Faces, a gay bar and nightclub.

Ashburn has voted against every gay rights measure the senate has voted upon, according to Project Vote Smart.

The California Highway Patrol says the Bakersfield lawmaker was arrested early Wednesday after he was spotted driving erratically. Ashburn was taken to the Sacramento County Jail, booked and then released.

Ashburn, the married father of four, was reportedly driving with a male passenger who was not identified.

A spokeswoman for the district attorney's office, Shelly Orio, said Thursday that a breath test showed Ashburn's blood alcohol level was .06 percent above the legal limit.

He was released on $1,400 bond.

The lawmaker was a no-show on the Senate floor Thursday. The state-owned vehicle he was driving when he was arrested has been impounded at the Capitol, Senate sergeant-at-arms Tony Beard Jr. said.

Well, avoiding a conviction is always good.

But if you’re arrested drunk, they’ll probably prove it with or without your consent.

And it doesn’t matter, with a refusal. You lose your license ~anyway~.

The BAC of .14 blows that theory all to hell. He was s%^%faced.

Straight men don’t get s%$#faced in gay bars. Makes it too hard to tell the trannies from the actual women.

Of course, there could be an innocent explanation for this, perhaps we could get Larry Craig out of retirement to write one up for us.

You do not have to explain to tgecworld as to why you do not have a DL but you will have to explain why you have a conviction.

However, here in Austin, they sometimes do forced blood draws fot all that refuse a breath test.

To many here (I am not one of them), gay conservative is a contradiction in terms.

I suppose I can be more specific in answering your question ...

- by entering a gay bar for purposes other than employment (at the bar) or religious outreach (no matter how ridiculous the idea);
- by leaving the gay bar drunk;
- by leaving the gay bar with a guy;
- by driving drunk away from the gay bar with the gay guy;
- by risking his career, his reputation, his marriage, and his family’s well-being for the opportunity to leave a gay bar, drunk, and with a gay guy in tow.

[pause while wife processes and then asks questions] Yea, I was leaving the gay bar Faces after closing time. Yea, I had an unidentified guy in the car with me, but don’t worry about that part of it.’

Put yourself in the wife’s shoes. I’m thinking it’s a Jenny Sanford moment, only worse.

Do his beliefs reflected in his votes, reflect what he truly believes, maybe from his own experience, to be true (even though he can’t live up to them), or does he not believe what he professes to believe about “family values”? That, not his failings against those values, is the real question.

I’m a lady. Yeah, she’d be upset about his DUI. However, just because you don’t know who the guy was doesn’t mean that he didn’t. What if the situation was: ‘Hi Hon. Got a bit of trouble. I know you’re going to be upset. I’m sorry. Steve and I were at Faces. I drank too much and tried to get home, but got pulled over. The media is going to be all over this. I really am sorry.’

The breathalyzer companies have tried to keep the code from defendants for a long time, but a courts finally forced them, and it isn't pretty. Ars Technica has a good article on it. I like this part:
The researchers also found that the device doesn't have any built-in sensors to determine if its physical state is consistent at any given time. When the code activates a motor or valve, the report says, it simply assumes that this function has been correctly performed and does not test to make sure. Some diagnostic routines in the code will silently return arbitrary default values upon failure, leading to potentially inaccurate breathalyzer test results. The software will also silently ignore errors in some cases unless there are a large number of consecutive failures.
I expect a high quality of software and hardware engineering to medical device specs if my job, my future are riding on the test results.

The worst part about breath tests is that they are by design readers of an approximation, an assumed 1:2100 ratio of alcohol in the breath to alcohol in the blood. That's only average, not everybody has that. The tests will over- and under-report on certain percentages of the population because of individual physical variables. Yes, your physiology can have you consistently blowing .09 when you're only .07.

Blood test is the only reliable test because it directly measures what they're looking for -- blood alcohol content.

I have nothing against homosexuals if they keep it private. But if this guy was indeed driving around in a taxpayer paid for vehicle cruising for young Latino boys, then he needs to leave office. There is something mentally wrong with an older adult male predating on young boys. Dr. Laura used to warn about this on her show, but the leftist freaks attacked her. Sorry, but no one can have integrity and at the same time find erotic stimulation from another male’s waste elimination canal. Hello?
