Obama carried Virginia in his historic ride to the presidency in 2008, the first Democrat to do so in a presidential race in 44 years. But since then, the tide has turned. Virginia’s Republicans routed Democrats in last year’s gubernatorial and legislative elections, partly because of public distrust of Democrats’ proposed health care reforms.
GOP lawmakers expedited the bill and three others like it as a legislative statement reflecting broad voter discontent over the proposed reforms. Virginia’s legislative session is, on average, the nation’s briefest, and the bill passed four days ahead of Saturday’s scheduled adjournment.

The legality of bills like Virginia’s is questionable because courts generally rule that federal laws supersede those of the states.
The bill’s sponsor, Del. Robert G. Marshall, R-Prince William, and other supporters advocated the measure as a defiant statement to an overreaching federal government. They say it falls under the Constitution’s 10th Amendment that deals with state sovereignty. Marshall said he expects the law to be challenged and ultimately decided by the U.S. Supreme Court.

Well if it is challenged and goes to the supreme court I’m certain they will be glad to move favorably after BO insulted and made a show of them at the SOTU address. Might be a nice pay back! tsk tsk...of course they would follow the letter of the laws...perhaps define them a little more carefully.

“There are limited powers the federal government has. Simply because of the supremacy clause, it doesn’t mean anything that the Congress does, in fact, must be enforced at all levels of government in the United States,” Marshall said in an interview after his bill won passage.
“It gives the state of Virginia the right to intervene on behalf of individuals should they decide not to pay for insurance and they refuse to pay the fine or they refuse to pay the fee or the tax or whatever you call it,” he said.
More distressing for Virginia Democrats was that 21 of their 39 delegates in the 100-member House sided with the GOP in defying the initiative that is their party’s national priority.
There was no immediate response to a telephone message seeking comment from former Gov. Timothy M. Kaine, now chairman of the Democratic National Committee.
DNC spokesman Alec Gerlach said Virginia’s legislation only burdens middle-income families struggling to pay insurance premiums and medical bills, adding “they’ll have to answer to those folks on election day.”
“It’s a rejection of the federal role in the provision of health care and an extension of the old idea of interposition,” said Del. James M. Scott, D-Fairfax. He was referring to a discredited legal theory that the state had a right to interpose itself to shield residents from some federal directives.

Congratulations, Virginia. This is a natural succession for the State that passed the “The Virginia Declaration of Rights” in 1776 to proclaim the inherent natural rights of men, including the right to rebel against “inadequate” government.

I’m having a dicken’s of a time trying to find out who the other 34 states are, on my 3rd search engine
What their stance does is prevent the Gov from forcing people to purchase insurance....I have a sense there are attorneys and business groups preparing for legal actions if this bill passes across the nation....I certainly hope so...and that we hear.

The Freedom of Choice in Health Care Act, which was recently the subject of a front-page New York Times article, has already been filed or prefiled in 33 states—Alabama, Alaska, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Michigan, Minnesota, Mississippi, Missouri, Nebraska, New Hampshire, New Jersey, New Mexico, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Virginia, Washington, West Virginia, Wisconsin, and Wyoming. Most notably, Arizona’s HCR 2014, a revised version of the ALEC model, will be put on the ballot in 2010.
Lawmakers in an additional four states—Montana, North Carolina, Rhode Island, and Utah—have publicly announced their intentions to file the legislation. A citizen-led initiative has also been announced in Colorado.

Guarding Against Mandates That Don’t Work
ALEC’s Freedom of Choice in Health Care Act would block legislation that imposes costly, bureaucratic penalties for choosing to obtain or decline health coverage. This provision strikes at the heart of an individual mandate—implemented in Massachusetts and elsewhere—that penalize individuals and businesses for failing to purchase health insurance.
The Massachusetts example is particularly instructive for states facing an individual mandate. Three years into the mandate, Massachusetts still hasn’t achieved 100% coverage—in fact, the Bay State still has more than 200,000 uninsured residents. Many of the uninsured were exempt from the mandate because coverage was too expensive. Over half of those who did get insurance got fully- or partially-subsidized coverage, courtesy of Massachusetts taxpayers.
What’s worse, health spending has increased by 42 percent in Massachusetts since the mandate was enacted; taxpayers, doctors, and hospitals are facing increased taxes and fees; and patients are finding it hard to see a doctor.
Simply put, ALEC’s Freedom of Choice in Health Care Act would protect against intrusive mandates that just don’t work.
