Analysis and text of "Anti-Bullying" bill S2283 -- includes unrelated "hate crimes" language to punish free speech across Massachusetts!

Also adds layers of costly bureaucracy to schools, mandatory reporting, openings for more homosexual programs. Will it even solve the problem?

SECTION 5. Section 98C of chapter 272 is hereby amended by striking out the first sentence and inserting in place thereof the following: “Whoever publishes any false material whether written, printed, electronic, televised, or broadcast with intent to maliciously promote hatred of any group of persons in the commonwealth because of race, color, religion, national origin, ancestry, sex, sexual orientation, or disability shall be guilty of libel and shall be punished by a fine of not more than one thousand dollars or by imprisonment for not more than one year, or both.”

Anti-Bullying" bill bullies free speech.

This has been posted before - and ignored by most FReepers it seems - but I thought both its better presentation and explanation at the above link, and its gravity warranted a repost, and as seen in the light of its contrast with other Mass General laws, CHAPTER 272, to which this hate crime provision adds to. This would easily enable the public censoring of Biblical doctrines, as well as multitudes of FR posts from Massachusetts, as what constitutes "false teaching" and willful promotion of hatred against such as aspects as religion and sex, sexual orientation is quite subjective, and it routinely (and self-righteously" used by liberal activists to silence those who oppose them.

Not formally, as they like to use it to give some flavor of historicity and authority, but their (Harvard, etc.) idea of the right use of liberty is to use it to sanction their liberal immoral ethos. As refuted here: http://peacebyjesus.witnesstoday.org/Homosex_versus_the_Bible.html

Liberals are going to be sorry if they do this. They have a whole array of race and anti-Christian, anti-Jewish hate doctrines they profess in an attempt to inspire hatred against heterosexual families, white people, white men and Christians in the spirit of superiority for athiests, non-whites, homosexuals, etc. That is what political correctness is all about.

They count on the idea that the ones they target for hate in their doctrines won’t be able to use these laws against liberals... They count upon inequality before the law for the groups they smear and hate. We should set about early and often weeding through the social and political doctrines of liberals to weed out their hate and intolerance - through the courts if need be.

Note the scope of the enforcers, and their freedom to falsely accuse:

49  (d) Each school district, commonwealth charter school, and non­public school shall  50  develop and update a bullying prevention and intervention plan...

111  (g) A member of a school staff, including but not limited to an educator, administrator,  112  school nurse, cafeteria worker, custodian, and paraprofessional, shall immediately report any  113 instance of bullying or retaliation he has witnessed or become aware of to the school principal or  114  to the school official identified in the bullying prevention and intervention plan as responsible for  115  receiving such reports or both.  Upon receipt of such a report, the school principal or his  116  designee shall promptly investigate.  If the school principal or his designee determines that  117  bullying or retaliation has occurred, he shall (i) notify the local law enforcement agency if he  118  believes that criminal charges may be pursued against the perpetrator; (ii) take appropriate  119  disciplinary action; (iii) notify the parents or guardians of the perpetrator; and (iv) notify the  120  parents or guardians of the victim, and to the extent consistent with state and federal law, notify  121  them of the action taken to prevent any further acts of bullying or retaliation. 

126  (i) A school employee, school volunteer, student, parent or guardian who, in accordance  127  with the applicable bullying prevention and intervention plan, promptly reports in good faith an  128  act of bullying or retaliation or an act which he reasonably believes is bullying or retaliation is  129  immune from a cause of action for damages arising out of the reporting itself or any failure by  130  the district or school to remedy the reported incident.

Liberals? Please, this is a system of political animals that wants to have a probationary criminal class to pay court fines and create criminal justice jobs. Tax collection by thuggery... it has nothing to do with political philosophy.

One might think so, even if conservatives used this against liberal hate-mongering, we must be aware of who is determining what constitutes false material and maliciously intent. BBBC World News - We have just received a report that the city of Cambridge, Massachusetts went on pink alert today, after a street evangelist offered a piece of gospel literature to a passerby. The man was arrested and charged with libel under a law which criminalizes the publishing of any “false material with intent to maliciously promote hatred of any group of persons because of race, color, religion, sexual orientation” and other aspects.

The evangelists was first detained by a resident, who made a citizen’s arrest, after the literature was judged to falsely accuse mankind of being sinful by nature, and to teach that homosexuality was wrong, and that Jesus Christ was the only way of salvation. Nearby Harvard University has already determined that these teachings are no longer true.

When the newly formed politically correct police (PCP) arrived the evangelist was charged with maliciously promoting hatred by virtue of the fact that one would not publish such literature unless he was in fact an intolerant hate-monger.

Your brief analysis in post one is accurite, the intention is not to protect those who are bullied, but instead, to bully those who are not PC as defined by Dear Leader.

We (the wife and I) continually cover our country in prayer that eyes would be opened and hearts changed. That is what this country needs most, to recognize the savior once again.
