Shortly before midnight on Sunday, Democrats released a 2,309 page health care bill that will start the process of reconciliation -- but don't let that fool you, it's not the actual reconciliation bill with all the changes you've been reading about. Instead, as Rep. Paul Ryan, the ranking Republican member on the Budget Committee, explained to me last week, this is just the "shell" bill -- the vehicle that Democrats need to get moving on health care. Once the bill gets approved (likely Monday), Democrats will send this phantom bill over to the Rules Committee, where it will be stripped, and then they'll insert in all of the actual changes that they've negotiated.

(a) ESTABLISHMENT.For years beginning with Y1, the Secretary of Health and Human Services (in this subtitle referred to as the Secretary) shall provide for the offering of an Exchange-participating health benefits plan (in this subdivision referred to as the public health insurance option) that ensures choice, competition, and stability of affordable, high quality coverage throughout the United States in accordance with this subtitle. In designing the option, the Secretarys primary responsibility is to create a low-cost plan without compromising quality or access to care.

The content of any final bill is irrelevant. Any federal version of health care on its face is unconstitutional since Article 1 Section 8 of the Constitution does not specifically grant Congress the power to regulate health care. The people are not bound to comply with any unconstitutional act of Congress. This is the point people need to be driving home with their Congress critters!

Sorry, but there have been a lot of laws passed that aren’t stipulated in the Constitution. Like all the determinations that have ensued from the virtual “right of privacy” (abortion, etc.) which ain’t in the Constitution, just in the minds of liberal judges and justices.
Why do you keep posting this? No matter how right you are on its face, the Supreme Court has ruled time and again since the 1930s against your statement. It’s irrelevant in today’s society, no matter how much you and I wish it to be true.
Who wants to bet that eventually this “law” will be the biggest body of law the world’s ever seen, and that will include a provision forbidding criticism of it.
I think the nation’s lawyers have just roped the moon if this passes. And it’s a lush fertile moon.
The supreme court also ruled on Kelo, didn’t they? After reading Men in Black, my low respect for them is even lower.
The debate truly is as simple as mentioning “enumerated powers”. It should be added to every thread about unconstitutional legislation.

I don’t think congressional staffers will have time to read/hear constituents mention every detail that’s wrong with this unconstitutional bill.
If it were to be fully implemented, people will be talking their ears off about skin rashes. That is not the purpose of congress.
That's as simple-minded of a solution as saying "throw the bums out" or "start a third party" is the fix in Washington. Present day politics is a lot more complex than that and if you don't play by the rules at the time, you will get burned by those who do. I'm sorry it's this way, but singing "LA LA LA" and sticking your head in the sand won't change it.

How do you know? I read the article but it will only be erased when the committee votes to erase it.
Remember that the dims in the house want the public option in the bill. The senate removed it in December because they needed 60 votes. If they use the nuclear option they won’t need 60 votes anymore.
It’s crunch time - keep hammering away at the Blue Dogs and let them know that the November elections will be ugly for them if they support this disastrous bill. Also that they are being duped by the leadership.

It’s DC that’s sticking it’s collective head in the sand. They tried to get rid of gun rights, and “simple-minded” people simply quoted the constitution. It took time, but at the mounting resistance.
And so you call up DC — how much attention will the staffer give you to complain about this clause or that clause? You’ll just be a chicken scratch on a note pad.
You write a long-winded email — same thing. A simple chicken scratch.
Some lady calls up about wearing her dead sister’s teeth and has the same impact.
Might as well keep it basic and simple. Same difference.
I’m not sure I follow the process...
1. House passes 2309 page bill with public option
2. House Rules strips content and inserts Senate Bill
3. Senate passes stripped House version via reconciliation
4. President signs law.
Is that it? So this is the Slaughter trick, isn’t it, where the House passes a bill they didn’t vote on?
