Oath of Office?

Posted on 03/19/2010 9:09:33 PM PDT by horsappl

If the House of Representatives uses the "Slaughter solution", in clear violation of article 1 section 7 of the Constitution, and Obama signs it, is not Obama in clear violation of his oath of office?

oath of office "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

article 1 section 7 "All bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States; If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by Yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively."

But article 1 section 7 ends with, "If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it"

Does this mean Zero may not need to sign it?

As crazy as everything is in this world today; who knows? But, I do think this HC Bill, if passed, will go to the Supreme Court. (The Supreme Court that Obama dissed and pissed at the State of the Union Speech.)

He is, but a democrat Senate is not going to impeach Obama for using the slaughter procedure that a majority of the house approved.

The Supreme court may or may not rule against it. But they simply won’t view that as a criminal offense.

It’s not clear to me whether they are even going to use the Slaughter rule. The Slaughter rule passed Thursday but the house are gearing up for a vote this weekend. On what? What are they voting on if they intend to use the slaughter rule?

Democrats can never be guilty of wrongdoing. They are perfect beings and authorized by an electorate full of
scu%bags to do what they want, when they want.

IMHO

-21 is NOT in violation of his oath of office here. He swore an oath to "execute" (ie: slay, douse, extinguish) the office of President, and he is doing a damned good job at it so far.

"I will...to the best of my ability, preserve, protect and defend the Constitution of the United States."

Obama is simply the least able president in history.

Yes. That's how this alien usurper non-American "president" probably plans to deflect the blame from himself for the imposition of tyrannical, communistic health care plan. He'll vote "present" again.

It is possible that this process may get started next year if the GOP takes over the house. However what is really going on is the beginning of a civil war.

To paraphrase Uncle Joe Stalin, "How many divisions does the Supreme Court have?"

It will be up to the likes of us to put this madness down.

It was a well polished act by then.

He does not have to sign - if he holds for ten days, it becomes law without signature.

The President can do three things: sign, veto, or hold for ten days [at which time it becomes law without signature].

Its been done before - usually signalling that the President disapproves of the law [but knowing that he will be overridden on veto, he lets it take effect].
