I don't know what to think of Kagan in terms of judicial philosophy. When she was Dean at Harvard, she was known for being a consensus seeker. Harvard University was rift with battles between the politically correct left and a few conservatives who were beleaguered. She sought to end the conflict. Conservatives on the campus describe her as scrupulously fair-minded and regard her as being a nice lady. However, being nice doesn't make one mainstream in legal thought, let alone moderate. In spite of her pleasant manner, she did support Harvard'd barring of military recruiters, for example. My impression of her is that she's a pleasant, likeable liberal, but liberal nonetheless.

I notice that Cass Sunstein isn't mentioned in the article as a possible SCOTUS choice, so that might be something to be glad about.
Could his nominee be all that much worse than Stevens, whom he/she will be replacing?
