Breaking: Militia group (Hutaree) charged with "seditious conspiracy" by FBI

In a press release just handed to Fox by the FBI, the six Michigan residents, two from Ohio, one from Indiana are charged with “seditious conspiracy.”

Reportedly, Hutaree is accused of attempted use of weapons of mass destruction. Charges range from August 2008 to today.

The militia group Hutaree are said to have conspired to oppose by force the authority of the US Government.

The members viewed local, state and federal law enforcement as "the brotherhood," also known as their enemy, and have been preparing, the FBI says, to engage them in armed conflict.

According to one plan released by the FBI, the group was to kill a law enforcement officer, then during the funeral precession, hit again with IEDs to kill more LEOs.

SPLC’s and CAIR’s involvement does stink. I don’t think we really know what these Hutaree people were doing. The allegation is that they were actively plotting to murder a police officer and then detonate a bomb at his funeral. We’ll see if they have enough evidence to support that allegation - that’s what trials are for.

I don’t know if those Islamic training camps involve actual terrorist plots, or, if they do, whether the feds know about them. I have a hard time believing that they’d look the other way if they did know, though. While I do know that American Islamic groups preach a lot of vile stuff, that’s not enough to constitute a criminal conspiracy. If there was evidence of an actual conspiracy or plot, I doubt even a hard-core leftist prosecutor would leave it alone.

Most federal prosecutors have political ambitions; that’s the nature of the job and the way they’re appointed. While I don’t doubt that some, if not many, sympathize with the likes of CAIR and the SPLC, their own careers come first. I don’t care what side of the aisle you’re on, being the guy who foiled a terrorist plot looks a hell of a lot better on your resume than being the guy who let a terrorist attack happen. If there’s a high-profile crime they think they can get a conviction on, they’re going to prosecute it.

I can think of several incidents when this could have been used, and wasn’t. I just wonder what makes this case different. It seems to me Michael Moore and Soros have been guilty of this, as well as those that pronounced “death to Bush” or said they would stop at nothing to see him out of office...

As to this group I don’t know anything about them and have no idea what they may be guilty of-or not. I will hold my judgement about this being right or wrong. It is definately something to keep an eye on and see how it all unfolds.

A colleague of mine made the very same point to me last Friday regarding my employer's cost to insure vs. paying the govt penalty. The objective for this law was to funnel everyone into the govt plan, and through additional legislation create the single payer system that has been the ultimate goal of the left all along.

These people are NOT what the founders had in mind.

Their Militia is an excuse for the Government to crack down on gun owners and protesters. This is a small group of idiots playing right into the the hands of the people they say they are against.

It’s not just planning. Conspiracy is an agreement among two or more persons to commit an unlawful act, and it requires that at least one of the conspirators commit an overt act to effect the object of the conspiracy.

Under Federal Law, the overt act is not a necessary element.

United States v. Shabani, 513 U.S. 10 (1994), was a decision by the Supreme Court of the United States regarding conspiracy liability under federal statutes. The Court ruled: "...Congress intended to adopt the common law definition of conspiracy, which does not make the doing of any act other than the act of conspiring a condition of liability..." This ruling indicated that conspiracy alone can be criminal.

The link below is to a Dept. of Homeland Security report, from last year, that starts with the "White Supremacist" and "anti-government" rhetoric claiming they have plans to carry out "violent acts" because of the current economic conditions causing foreclosures, unemployment, the first black president, etc. as well as saying the conditions are ripe for "recruitment".

It's interesting reading in light of current events.

This is a small group of idiots playing right into the the hands of the people they say they are against.

That's why I find it so interesting that they were in such a rush to drag the Michigan Militia into their mess. Its almost as if the raid were bait to draw others in and I for one am glad to see that the Michigan Militia acted wisely and told them to fend for themselves.

Why is the FBI not arresting Wahhabi Muslims like Major Hussien and all of the plane hijackers. They all conspired in the same Wahhabi Mosque in Virginia but they are arresting these folks? I want to see evidence. I smell obama trying to intimidate Christian people.

Well, seditious conspiracy requires a lot more than simply advocating against the government, even if that involves advocating the overthrow of the government or the killing of government officials. There actually has to be an to use force against the government.

As much as I despise both Moore and Soros, I don’t think they’ve quite done that.

Now, the next section of the U.S. Code, 18 U.S.C. § 2385, does make it a crime to advocate the violent overthrow of the government, as well as to be a member of a group which does so. That section is, I think, a bit more dangerous than the seditious conspiracy section, though “advocacy” in that context requires that someone “urge” or “plead for” the use of force against the government.

As a bit of background, the seditious conspiracy section dates back to 1861 - it was one of the earliest pieces of legislation signed by Lincoln. The “advocating overthrow of the government” section was part of the Smith Act of 1940, and was primarily targeted at communists, particularly communist immigrants.

Christian Militia.......or are they? The thought comes to mind that this could be another setup. Is there some way we can get personal information on the guys listed in the indictment? What if they are not really Christian Militia, but plants? Anyone living close to any of these guys, try to find out who they really are from neighbors, records, etc. I’m not buying it just yet. Christians don’t do this sort of thing, but the progressive enemy most certainly would go to the trouble to hire these guys to play the part. Even provide them with the uniforms & weapons.

From what I know so far.... here are my thoughts on this. I believe they did it now to draw attention away from the Health Care disaster. They need to get rid of the uprising and tea parties. They will someone tie this into it. That small militia group were incredibly stupid. They put videos up on You Tube and they have big mouths.
A real militia group, if they were indeed planning something, would go underground. They would speak only to people they knew and trusted and they would be a hell of a lot bigger than that group.
I don’t know if the charges are true or not, but if they are, they are morons. Killing a cop, then killing more at the funeral. How stupid is that and what good does that do? I can’t be on their side if that is true. They are idiots if it’s accurate.
The militias to worry about are the ones that you never hear about.

Sick but effective if you’ve ever seen a police funeral, I think the one for the ones killed in Washington state attracted 20,000 cops. These guys were probably egged on by the FBI informant/agent that infiltrated the group but even so you have to be door nail dumb to actually even talk about something like this. Militias may be considered a counterbalance to the Federal government but they are not authorized by the constitution to plan for the over throw of the government.

I would expect to see more of this type of thing from the government just like during the Clinton days. They will be gunning for “right wing” extremists which means any odd ball loud mouth that likes to talk big is going to get the special treatment. Even if you’ve done nothing wrong they can still quite easily convince a jury or judge that you’re guilty of something and send you away for a long long time.

Again, that's why I found it interesting that they immediately asked if they could hide on Michigan Militia property. That's an almost too convenient means of bringing the feds down on the MM.

Fortunately the MM has been around for decades and knows how to keep their distance from trouble.
