Justice Stevens says he will 'surely' retire during Obama's presidency By Jordan Fabian - 04/03/10 04:47 PM ET

The usually reticent with the press Justice John Paul Stevens gave two major interviews this weekend that provide new information about if and when he will retire from the bench.

Speculation has arisen that Stevens, 89, will step down sooner rather than later. The White House is preparing for confirmation proceedings over the summer, the New York Times wrote Saturday.

In an interview with the Washington Post, Stevens, who is considered a member of the liberal wing of the Court, Stevens said he will "surely retire in during Obama's presidency. His first term expires in January 2013:

Whether it is this year or the next, he said, he will hand President Obama his second chance to leave a lasting mark on the nine-member Supreme Court. "I will surely do it while he's still president," Stevens said.

Stevens, who turns 90 later this month, isn't quite ready to say. "I can tell you that I love the job and deciding whether to leave it is a very difficult decision," he said in an interview. "But I want to make it in a way that's best for the court."

He acknowledged that he had told a reporter early last month that he would decide in about 30 days, but laughed that he hoped "that wasn't being treated as a statute of limitations."

The Times reported that he said:

“I do have to fish or cut bait, just for my own personal peace of mind and also in fairness to the process,” he said. “The president and the Senate need plenty of time to fill a vacancy.”

I think Republicans can filibuster this in the Senate indefinitely if they have the guts. Correct me if I’m wrong.

Well yeah. It almost doesn't matter, since it is hard to imagine how anyone oculd be worse than he is now. Just stretches out the vile obscene incompetence for another thirty years or so, is all.

Deval Patrick has a better chance of replacing Eric Holder for the Deputy AG slot. Anything that officially creates “ex-Governor Deval Patrick” will make me feel much better.

I’m sure he will, so that Obama will have the chance to appoint another liberal to the court. God forbid Stevens holds off retiring, and a conservative Republican is elected President in 2012. He’d kick himself if THAT happened!

Souter was named by a Republican but waited for a Democrat to be able to pick his successor.

Stevens may want to retire before the November elections so that Obama can pick a further-to-the-left replacement than may be possible next year. But even if the Republicans regain control of the Senate, all Obama has to do is pick a minority nominee and enough of the Republicans will vote for him or her out of fear of being called racists.

I think we have Clarence Thomas in there because of the Gulf War--Bush's popularity right afterwards made Thurgood Marshall assume he would be re-elected. He could have stayed on the court until his death and then Clinton would have chosen his replacement.

Stevens is an @ss*ole and Obama will pick a young, radical and likely before November. Unless one or more of our five meet our Creator, we’ll be all right until 2012 when we can anticipate retirements and our own appointments.

I doubt it. The only good news is Obama could search the Taliban, retired KGB or his own Ameeican Nazi Party and could not find a worse Supreme Court Justice. He'll have to settle for one just as bad.
