Immigration Advocates Vow to Fight Arizona Law

PHOENIX -- Arizona's governor vows the state's tough new law targeting illegal immigration will be implemented with no tolerance for racial profiling, but at least two advocacy groups were preparing legal challenges and Mexico has warned that the law could affect cross-border relations.

Gov. Jan Brewer on Friday signed into law a bill that supporters said would give police more powers to deal with illegal immigration in Arizona, the nation's busiest gateway for human and drug smuggling from Mexico and home to an estimated 460,000 illegal immigrants.

After violently throwing his ex-girlfriend against the wall and then dragging her up a flight of stairs to a bedroom, Eduardo Juarez of Round Lake Beach man then attempted to choke the woman to death.

Pretending to be dead, the woman then listened to Juarez talk on the phone, discussing how to dispose of her body, according to Assistant State’s Attorney Fred Day.

“This altercation with the defendant nearly cost her life,” Day said at the man’s sentencing hearing Friday.

In January, a jury found Juarez, 39, guilty of unlawful restraint and battery for the April 4, 2009, attack. The jury acquitted him of attempted murder and aggravated battery.

“What happened in this case was brutal and out of line,” Associate Judge Daniel Shanes said.

He sentenced Juarez to three years in prison, the maximum penalty.

Day asked the court to impose the three-year sentence, calling the defendant’s actions “heinously cruel” behavior.

“The defendant is a man of many faces. He is a master manipulator. I imagine he feels he is in control as he sits at the defendant table,” Day said.

Defense attorney Eric Rinehardt asked the court for probation instead of prison.

“He has alcohol and perhaps anger issues — exactly the situation for probation and counseling,” Rinehardt said.

He also said Juarez has been involved in church and baptized since the incident.

Shanes said it was “good” that Juarez was attending church because it shows that he is “trying to reach improvement.”

However, Shanes proceeded to list the Juarez’s criminal history, which includes a battery in 1991, attempted forgery in 1992, obstruction of justice in 2000 and a federal crime that resulted in deportation in 2002.

A few months after being deported, Juarez returned to the United States illegally, Shanes said.

“Some would say that by being here in the country illegally, the defendant is committing a crime every day,” Shanes said.

Federal authorities may decide to deport Juarez after he serves his prison sentence, Shanes said.

Juarez addressed the court through an interpreter and talked about how he was trying to change himself by going to church.

“I do want to ask for forgiveness and to get the opportunity to show I can be a better person,” Juarez said.

While the Obama administration focuses on prosecuting law enforcement officials, Arizona has passed sweeping legislation to curb illegal immigration.

While the pleas from American citizens in Arizona and other states fall on deaf ears in Washington, DC, the violence and crime at the U.S.-Mexico border continues unabated.

In yet another example of violence spreading north of the border, a deadly Mexican gang is actively plotting to kill U.S. law enforcement officers and their families in Texas, according to a Department of Homeland Security alert that warns U.S. cops to wear body armor and vary routes to avoid being tracked.

The U.S. government has spent billions of dollars to fight Mexican drug cartels yet they continue to be the nation’s largest supplier of illicit narcotics and violent Mexican gangs have expanded into every region of the country, including idyllic rural areas.

“This is hardly earth-shattering news since Mexico has long represented the single greatest drug trafficking threat to the U.S., despite Uncle Sam’s multi billion-dollar effort to halt the northbound flow of narcotics. The costly investment has failed miserably, according to a federal report that reveals Mexican heroin production has actually doubled in the last year,” state officials from the public-interest group Judicial Watch.

In the absence of federal enforcement a Mexican border state — Arizona – drowning in an illegal immigration pandemic has passed legislation that bans “sanctuary city” policies and makes it a state crime to be in the U.S. without proper documentation.

The law marks an unprecedented effort by an American state to take immigration matters into its own hands since immigration offenses are currently violations of federal law that cannot be enforced by local police. But lawmakers in Arizona are fed up with the enormous toll that illegal aliens are having on their state as the feds sit idly by and fail to secure the southern border, according to a Judicial Watch report obtained by the National Association of Chiefs of Police.

In the past few years they’ve chipped away at the crisis with other measures, though this is by far the most hard-hitting and definitely among the country’s toughest immigration enforcement laws. The measure, passed last week by the Arizona House and previously approved by the Senate, grants police the power to stop and verify the immigration status of anyone suspected of being illegal and requires foreign nationals to carry proof of legal residency. This includes the man known as “America’s sheriff” Joe Arpaio of Maricopa County, which includes Phoenix.

Sheriff Arpaio has been targeted by the Obama Justice Department and Democrats in his own state because of his tough immigration enforcement policy.

Illegal aliens will be charged in state court with trespassing and anyone — documented or undocumented — seeking work from a road or sidewalk will also be criminally prosecuted. Drivers who pick up illegal alien day laborers will also be punished when the law kicks in.

Predictably, immigration advocates are incensed and have called on Arizona Governor Jan Brewer to veto the measure which they assert is racist. The legal director of an influential national group La Raza that represents day laborers calls it an “unconstitutional, unwise and odious bill” created by “demagogue leaders” who have become folk heroes for “white supremacists” throughout the country.

Arizona lawmakers have long searched for ways to curb the colossal impact that illegal immigration has had on their state. A few years ago they enacted a law that punishes businesses that hire illegal immigrants, though the state has not penalized a single employer. Legislators allocated sufficient funds (about $5 million) to enforce the law but a chunk of the money remains largely unspent by counties throughout the state, according to the JW report.

It's EXACTLY those items, whether LEO is able to find cover for them or not, that allow them to identify the illegals.

Brown, can't speak english...looking poor.

It IS the profile.

Anyone know whether racial profiling is illegal? I THINK it's not illegal as DHS now uses it to profile for shoe bombers and such. I believe it's only actual enforcement of the law that's subject to Equal Rights laws and precedent...not the initial identification of suspects.

Not all illegal aliens crossing into Arizona are Hispanic. Hundreds are from other parts of the world, like Asia, Africa, the Middle East and Europe.

You ask them the “illegal” question in the line of other LE work you are doing. If something comes to your attention as you deal with them on other LE matters. An exception might be if you see a bunch of day laborers gathered where past experience says illegals are hired, then that LE matter coincides with the “illegal” question. Otherwise, you do NOT look at someone and say to yourself, hey, an Hispanic, gotta ask them if they’re legal.
