If this is true it adds more credibility to the arrest scenario. However, it sounds more like a clumsy cover story concocted by the media to muddle the discussion. Unfortunately, these days you simply can't trust the media to give you the facts or the truth.

Going about armed to the terror of the populace was codified into N.C. common law in the 1969 session of the N.C. General Assembly.

It's in the 14 series General Statutes.

NCGS 14‑288.3. Provisions of Article intended to supplement common law and other statutes.

The provisions of this Article are intended to supersede and extend the coverage of the common‑law crimes of riot and inciting to riot. To the extent that such common‑law offenses may embrace situations not covered under the provisions of this Article, however, criminal prosecutions may be brought for such crimes under the common law. All other provisions of the Article are intended to be supplementary and additional to the common law and other statutes of this State and, except as specifically indicated, shall not be construed to abrogate, abolish, or supplant other provisions of law. In particular, this Article shall not be deemed to abrogate, abolish, or supplant such common‑law offenses as unlawful assembly, rout, conspiracy to commit riot or other criminal offenses, false imprisonment, and going about armed to the terror of the populace and other comparable public‑nuisance offenses. (1969, c. 869, s. 1.)

I appreciate your serious answer on that even though I was being a bit facetious. I expected that it was sort of a legalese shorthand for "terrorizing the public" rather than the way it sounded. I was also pretty suspicious that it was a "gotcha" charge as you confirm.

I guess if there's more to the story we will hear about it soon enough but odds are this guy had no idea the President was in town.

In post #42 I forgot to add that the simple reason the “impersonating a police officer” story sounds fake is that if it were so, that’s what he’d have been charged with. It’s a far more clear, direct and easily justifiable charge for the arresting officers to make stick.

Hm, About a year ago I got into a discussion with someone who was advocating a “mobile no-gun zone” around the President and other officials... I countered with a scenario much like this: some guy going about his business, legally armed, may suddenly become a criminal because the president passes ‘close’ by.

Yep.

Imagine any LEO that would have let any person named “McVey” just walk while picking his nose and doing anything that we may be able to construe as potentially offensive to the ONE that isnt even here any more......said LEO would be crucified for letting the second McVey go and he shot-up the busload of nuns that Obama was changing the tire on......

Got to love this country, a 100K bond for bogus misdemeanor? The guy should walk on Monday when he is arraigned by a real judge and when he has a public defender. The NC police know that this law is going away soon, but they keep using it.

Yeah, and I found a website that says that McVey has an amateur radio license which explains his radio equipment.
