NEW YORK, April 29, 2010 (LifeSiteNews.com) - Citing the shortage in organs available for transplant, a state assemblyman in New York has proposed that all citizens of the state become automatically enrolled as candidates for organ harvesting.
New York State Assemblyman Richard Brodsky has introduced a new bill in Albany that aims to enroll all New Yorkers as organ donors unless they take action to opt out.
If passed, Brodsky's bill would become the first such law the U.S. However, a similar bill was also introduced in Illinois earlier this year.
"We have 10,000 New Yorkers on the list today waiting for organs. We import half the organs we transplant. It is an unacceptable failed system," Brodsky said, according to CBS News 2. Brodsky pointed to other nations who have passed similar laws that now are in force "without a lot of controversy."
Despite the altruistic goal of such legislation, the current practice of organ harvesting has increasingly alarmed the pro-life community, as evidence continues to surface that the prerequisite "brain death" is often defined to ease the process of collecting fresher organs, rather than according to whether a person has actually died. The prestigious New England Journal of Medicine confirmed these fears in a 2008 article that backed up the notion that "brain dead" patients are often, in fact, still alive.
Cases such as that of 21-year-old Zack Dunlap, whose organs were nearly harvested before he suddenly responded to a family member's last-ditch attempt to communicate with him, have forced pro-life doctors to question how many other donors were in fact alive and responsive to pain at the time their organs were removed.
According to LSN medical advisor Dr. John Shea, such donors are often given drugs to paralyze muscles before the process, to prevent them from moving, making it impossible to know whether they are aware or not. In a 2008 New York Times article on the use of anesthetic in neonatal operations, anesthesiologist Mark Rosen noted in passing that stress hormones are known to increase in "brain dead" patients during the organ harvesting process.
The question of "brain death" has even received attention by the Catholic Church: In a Vatican conference on "brain death" last year, doctors informed officials of evidence that the death of an organ donor occurs, not at the point of "brain death," but due to the removal of his or her vital organs. Pope Benedict XVI warned the conference that "the main criterion" for organ removal must be "respect for the life of the donor so that the removal of organs is allowed only in the presence of his actual death."

I would normally be a willing donor, or at minimum ‘not care’, but will OPT OUT if these a**holes and leeches ever pass a law like this in my area.

OMG - we’ve gone from a couple of bad elections to a Police State in 30 months.
Well with obamacare’s death panel determining when a person is brain dead, this was the next logical step, big money to be made.
The French drug addict who’s dog ate her face... Remember her ?
She was the first to receive a “Full face transplant”. She was also caught sneaking out of her room several times to grab a quick smoke. And after her recovery, she is in and out of drug rehab.
Her face was “harvested” from a comatose mother in a french hospital. Her family continued to visit her and hope for her awakening. Now she has no face. She is being kept alive on machines to harvest her organs. Wrapped up in protective blankets, pieces of skin missing and open sores under constant irrigation to “Keep the meat fresh”.
I think we should all do what we can, and what we must, to prevent this sort of thing from happening.

TEL AVIV President Obama’s newly confirmed regulatory czar defended the possibility of removing organs from terminally ill patients without their permission.
Cass Sunstein also has strongly pushed for the removal of organs from deceased individuals who did not explicitly consent to becoming organ donors.
In his 2008 book, “Nudge: Improving Decisions about Health, Wealth and Happiness,” Sunstein and co-author Richard Thaler discussed multiple legal scenarios regarding organ donation. One possibility presented in the book, termed by Sunstein as “routine removal,” posits that “the state owns the rights to body parts of people who are dead or in certain hopeless conditions, and it can remove their organs without asking anyone’s permission.”
“Though it may sound grotesque, routine removal is not impossible to defend,” wrote Sunstein. “In theory, it would save lives, and it would do so without intruding on anyone who has any prospect for life.”

Since you can choose to opt out when applying, I think I see this as a “good thing.”
You can’t take your organs with you, so why not donate?
Ya know, one things I think we should do is make all prisoners, especially the ones on death row, organ “donors.”
As soon as we have a bunch of recipients lined up and ready, have an execution, then hand out his organs. Donate a kidney and get get 5 years knocked off your sentence; donate bone marrow and get a year off; etc.
We’re missing an opportunity here for convicts to play society back for their crimes.

I could counterargue your stance for a bit, but I would like to instead offer my own reasons why I (no longer) have volunteered my organs for donation.
I am a 34 year old smoker. I have bone deformities, and an alarming case of arthritis. I’m in good shape, and my organs are pretty ok.
Were I to die, my body would be rejected for medical practice. (The whole deformities thing right off the bat, the smoking thing to boot). Instead my body would be shipped off to a Cadaver mill, where I could be purchased by several research facilities, including the FBI.
If I were purchased by the FBI for about $100, They would dump me out of a bag into a field where my corpse would rot for a charted amount of time, and their forensics students would study the remains. They may shoot me or stab me a few times for their classes.
Other companies may purchase my body (again, for about $100) for studies. This may include cosmetic companies, universities, or household cleaning companys such as Johnson and Johnsons, where they may study the effect of submersing a body in a pool of windex to satisfy a health label on the bottle that says something like “Do not swallow. Use externally. Do not soak in.” and things of that nature.
I’m not a fan of this fate.
These are only the companies that I know of who practice this. I have heard of these practices from those who work in the labs, and found out about the FBI thing on TV.
