A former Gwinnett County police officer was indicted Wednesday for allegedly stunning a Waffle House employee with a Taser as a prank.
A grand jury indicted Cpl. Gary Miles on charges of aggravated assault and violation of oath of office. He resigned from the department last June. Miles is out of jail awaiting trial on $8,100 bond.
The waiter, Daniel Wilson, 23, told investigators that Miles was a frequent patron of the restaurant at 2725 Grayson Highway in Loganville. Wilson said he was chatting with two other Gwinnett County officers on Feb. 16, 2009, when Miles came up from behind and zapped him with the Taser. He said Miles and the other officers laughed as his knees buckled and he fell to the ground.
Miles told investigators that he only "spark tested" the Taser near the employee's back "just to scare him a little bit, " according to an internal investigation file. A lawsuit that Wilson filed against Gwinnett County and the three officers is still pending in State Court.

Article says it was a “waiter.” You may want to rethink your title.

Since, depending on your health these things can kill, he should have been indited for attempted murder...

I was thrown for a bit of a loop on that waiter/waitress thing as well.
The male chauvinist in me would have been livid if this were pulled on a waitress. It was unacceptable enough to see it done to a waiter.
How’s that for a thanks for good service, perhaps even some free coffee and pastries?
Very poor judgment. The officer just wasn’t thinking.

It flors me that people like this get hired by law enforcement in the first place.

"spark tested" Maybe could have been resolved with the "fist in face test." Of course, pigs operate on a self styled, shifting set of double standards so that could create its own slew of problems.

This cop was in the wrong, but I still do not appreciate the use of the word "pigs' to describe law enforcement officers.
Are you from a 70's biker movie?

Not I. Having circumstantially been forced to interact with a representative or two of such agencies.

"I still do not appreciate the use of the word 'pigs' to describe law enforcement officers" Same here, but it's appropriate.

"Are you from a 70's biker movie?" No, you must be thinking of the motorcycles that were often called "hogs" back then, lol.

Welcome to Gwinnett County, land of corrupt commissioners and a DA who won’t prosecute.

"It flors me that people like this get hired by law enforcement in the first place." Well at least his fellow officers didn't tolerate it. Oh wait. They laughed about it.

Waffle House employees are probably accustomed to getting tased, among other things.

Waffle House employees are probably accustomed to getting tased, among other things.Even at Waffle House, I think that would constitute a hostile work environment.
