As an officer, simply having the order issued by Lieutenant Colonel William Judd or Colonel Gordon R. Roberts is not sufficient to make it a "lawful" order, as it would have been for enlisted personnel. As an officer, Lakin's pledge of true faith and allegiance is to the Constitution and not to his superior officers. One cannot be expected to defend the Constitution against domestic enemies, which is Lakin's sworn duty, if the domestic enemy is immune to all form of investigation -- even such a simple inquiry as "are you a natural born citizen?". If this Courts Martial finds him guilty, truly the very oath itself taken by all officers is meaningless. Without such a protection in place, the military becomes nothing more than a tool of the Executive Office -- a very dangerous an un-Constitutional scenario. Officer's must never swear allegiance to people, only to ideals and, specifically, the ideals of our Founders.
