In her private meetings with Senators, Elena Kagan is making a point that's pretty hard to dispute. But in doing so, she's turning up the pressure -- on herself.

Kagan, the no-nonsense solicitor general, is criticizing past Supreme Court hearings as lacking in substance -- and the performance of at least one justice now on the Court, according to senators who talked to her.

"She identified a specific justice who she thought was not appropriate in responses," said Pennsylvania Sen. Arlen Specter after he met with Kagan. "I'm not going to tell you who it was, but I'm going to take a look at that record in preparation for the questioning."

Hers is a widely shared view: Senators pontificate; nominees stonewall.

"The last several hearings have been, as she has indicated, pretty superficial," said Wisconsin Sen. Herb Kohl, who met with Kagan yesterday.

Kagan tackled the problem in a 1995 University of Chicago Law Review article. She said the hearings had become a "farce" and a "vapid and hollow charade." Not since Robert Bork, she wrote, had any nominee candidly discussed his or her views.

It is interesting that we have a nominee with zero substance critiquing the sc nomination process as not having substance. Who is she to criticize? What has she ever done? She has never even been a judge.

And looked what happened to him. No wonder nominees don’t want to answer questions specifically any longer.

And we see how well that worked out for Judge Bork.

The despicable Dems demagogued him into some sort of cartoonish evil villain from a Quentin Tarantino movie.

When it comes to approving judges, the disparity between the rules by which the two parties operate is nonsensical.

One Question with all of the included wording:

Ms. Kagan; Aside from your never having served publicly as a Judge, in your University of Chicago Law Review article in 1996 titled "Private Speech, Public Purpose: the Role of Government Motive in First Amendment Doctrine" you argued, that restricting free speech is a legitimate role of government. Other than falsely shouting "Fire !" in a crowded theater, why do you advocate against Constitutional First Amendment guarantees of Freedom of Speech ?

Yeah. To me, the capper in the Bork hearing, the absolute nadir, was when Sen. Howell Heflin (D-Alabama) told Judge Bork, "I don't like your beard."

Sen. Heflin was also famous for once feeling a sniffle coming on and pulling a pair of womens panties out of his pocket to wipe his nose. He then issued a press release saying it was his wife's white panties that he picked up by mistake, so from henceforth he would buy only colored handkerchiefs.

Oh, I look forward to another Bork type hearing. Too bad the old fart Heflin is no longer with us. But we have comedian Al Frankin waiting in the wings.

The cruelest thing about confirmation of Kagen would be subjecting the fine members of the court such as Roberts, Alito, Scalia, and Clarence Thomas to a lifetime of having to look at her.

Ginsburg was bad enough - this would be cruel and unusual punishment.
