Obama appointee to the Supreme Court, Elena Kagan, didn’t do her homework before arguing the Citizens United case on behalf of the Obama administration and the FEC — which her probably-soon-to-be colleagues on the Supreme Court wasted no time in pointing out.  It came at the very beginning of her oral arguement, when one might expect a Solicitor General to attempt to impress the panel with her grasp of law and precedent: the crux of the case was the issue of limiting expenditures as an expression of political speech, not contributions.  Kagan started off her argument by misconstruing the issue and then offering a factually incorrect reading of precedent.  Both Scalia and Kennedy objected to it before Kagan even had time to get the argument completed

The administration told congressional leaders in a letter on Monday that it has made "significant progress" implementing the health care overhaul, including a load of consumer friendly provisions that could ease negative perceptions of the plan among a skeptical public. The letter is part of an administration campaign to convey the impression that the debate is over and the health care train is leaving the station.

WellPoint CEO Angela Braly blasted President Barack Obama for repeating a charge that her company singled out and dumped women with breast cancer from its rolls. In a sharply worded letter to the president sent on Sunday, Braly said the characterization “grossly misrepresents” reality. Braly criticized Obama for raising the point in his weekly address on Saturday. In a major victory for organized labor, unions will have an easier time signing up airline and railroad workers after the Obama administration Monday changed a 76-year-old rule on union elections. The new rule, announced by the three-member National Mediation Board, would recognize a union if a simple majority of workers who cast ballots approve organizing. The previous rule required a majority of the entire work force to favor unionizing. That meant workers choosing not to vote at all were effectively counted as "no" votes.

The new federal health-care law, or “ObamaCare,” claiming to eventually provide coverage to more than 30 million uninsured Americans, is already being used by scam artists to prey on those in need of care, Penn. state Insurance Commissioner Joel Ario said Monday. Scam artists are already at work, according to Mr. Ario, attempting to sell the federal plan to those who believe they are in need or simply want to get into national health care early.

Republicans are questioning Obama Supreme Court nominee Elena Kagan’s ties to a liberal icon and the nation’s first African American Supreme Court justice, Thurgood Marshall.   In its first memo to reporters since Kagan’s nomination to the high court became public, the Republican National Committee highlighted Kagan’s tribute to Marshall in a 1993 law review article published shortly after his death.  Kagan quoted from a speech Marshall gave in 1987 in which he said the Constitution as originally conceived and drafted was “defective.” She quoted him as saying the Supreme Court’s mission was to “show a special solicitude for the despised and the disadvantaged.”

At Harvard, Obama nominee Elena Kagan reinstated a ban on military recruiters using the Harvard Law School Office of Career Services – and then under pressure from the Bush administration, she lifted the ban.

The Obama administration is “pleading” with Congress to give military personnel a much smaller increase in pay than proposed by lawmakers.

The Weekly Standard Obtains Top Justice Department Official's Recusal Document.  In last week's cover story cover story, Jennifer Rubin described the run around she received in response to her Freedom of Information Act (FOIA) requests for documentation of recusals by Justice Department lawyers who previously represented Guantanamo detainees. The official responsible for documents from the top offices at DOJ--the attorney general, deputy attorney general, and associate attorney general--told Rubin the documents were not in a readily accessible place, that three individual attorneys' offices would need to be searched, and it would take a total of eight to eleven months to produce them. However, THE WEEKLY STANDARD has now managed to obtain one of these documents--an apparently complete list of the recusals by Thomas Perrelli, the associate attorney general (the number three attorney in the Justice Department). Covering cases and clients Perrelli or his former law firm (Jenner & Block) worked on, it is six pages long and includes a list of forty-one cases involving former or current Guantanamo detainees.
