Memorial Beads or Gang Symbol? Student Suspended for Wearing Rosary
Case Highlights First Amendment Free Speech Debate in U.S. SchoolsWASHINGTON, May 25, 2010
Hosier, a 13-year-old Schenectady, New York, boy, is gearing up to file a federal suit against his middle school after he was repeatedly suspended for wearing a rosary, which he says is in memory of his older brother who died in a bike accident.
Students say they were singled out because they had on black T-shirts. Hosier said he has worn the rosary since September, but in the last week was suspended three times, most recently on Monday, when he arrived at school with the beads outside his shirt.
"When I wear the rosary beads," Hosier says, "my brother's memory is alive." His brother, Joey Hosier, was holding the rosary when he died.
But officials at Oneida Middle School say the district's code of conduct clearly states that beads worn outside of the shirt are forbidden.
"Beads are often identifiers for gangs," says Karen Corona, who handles communications for the Schenectady City School District.
"The code of conduct is entirely about keeping students safe. Unfortunately, we live in an area where we need to do that. We try to take every step possible to keep the displays out of school."
Hosier says he has worn the beads for the entire school year and was only recently asked to tuck them inside of his shirt. When he refused, he was suspended -- twice last week and again on Monday, he says.
"I feel that it's not right to suspend me because I have my own rights to wear my rosaries and they are taking away my religious rights to wear what I remember about my family members," he says. "I told them I wasn't in a gang, and that purple is not a gang color."
Hosier is being represented by the conservative American Center for Law & Justice, which has argued several cases nationally involving freedom of speech and religion.
The lawyers are planning to file a suit in federal court claiming the school violated Hosier's constitutional rights to free speech.
In a letter to school officials the lawyers write, "Raymond's rosary is a form of symbolic speech. Raymond has a First Amendment right to continue to wear his Rosary to school."
Experts on such cases believe that Raymond could well win his case. Across the country, as schools are cracking down on gang activities, students are filing more and more challenges to protect their freedom of expression.
Critics Say Rosary Ban Defies 'Common Sense'
"There are religious liberty issues in a case like this as well as freedom of speech issues," says Charles C. Haynes of the First Amendment Center. "I think school districts are overreacting in banning things they think might be harmful or related to gang violence."
Haynes says the school district has to show real evidence of a connection between the beads and gang violence and says the case becomes more of a challenge for the school when the expression in question has religious significance.
Ed White, a lawyer representing Hosier, points out that a federal judge in Texas ruled on a similar case in 1997. The judge ruled in favor of students who wanted to wear glow-in-the-dark rosaries that the school thought might be gang symbols.
Last year a federal judge in New York also found against a school's code of conduct.
"It comes to a point where you have to apply some common sense," White says. "Common sense is not being applied in Schenectady."

A Rosary is not an article of jewelry, like “beads” are. However, I have always been told that it is right to “wear” a rosary. But the school has its rules, so the kid should comply. Just because he wasn’t caught wearing them earlier does not mean he can do it now.
The kid is wearing the Rosary in memorial to his brother - who was wearing this same Rosary when he died. If you consider that to be merely a fashion statement - then you have no initiating conversations about common sense.

I believe that the United States has been chosen by G-d and designated by G-d as the protector of Israel. I believe that we will ultimately have to seek out the most righteous among us and plead for our country to be allowed to survive. But that survival may require a purge among us - to set ourselves apart from the people who are doing these wicked things.
Pray to G-d that the decisions made in secrecy to allow Nazi scientists and their families to enter this country after WWII do not bring about the destruction of our country. OMG the things they have done in our name - the horrors, the way we have allowed our own citizens to be used for their twisted experiments is something that is repulsive in the extreme.
Just because someone tells you that they are a Jew or a Christian does not mean that they are telling the truth. These evil people have to hide because what they do will not be accepted by a civilized society. They hide as Americans and they hide within the very Church itself - some of the information will be difficult to understand and accept. Some is so outrageous that it seems like a movie plot - but there is too much evidence to ignore. A person who does not believe in G-d and does not value life will do whatever it takes to complete their “experiments”.
It appears that many of the young Catholics who are ending up dead might be sexual abuse survivors, I just can’t tell yet. I don’t like to make accusations against the Catholic Church because I do not believe that the Church is responsible for these criminals. I believe that these people sometimes HIDE in the Church so that they can remain free to continue their behavior.
It is much the same as these “scientists” hid in our government service, above suspicion. I believe if the truth came out all at one time it would cripple our government. I also believe that there are decent, G-d fearing people working in the service of our country. The truth is always a double-edged sword and the difficulty in using that sword is control of the weapon so that the enemy is destroyed without killing ourselves at the same time.

Chris Jenkins’ parents Steve and Jan Jenkins hired private investigator Chuck Loesch.
Loesch said two different sets of bloodhounds took handlers to the same parking area. Both traced Chris Jenkins’ scent from the bar where he was last seen to a nearby underground garage.
The bloodhounds indicate Jenkins got into a car, which headed west on Interstate 94.
“I think Chris was either abducted or walked into a position where he was murdered,” Loesch said.

A bloodhound found both Josh Guimond and Christopher Jenkins’ scent at the university. On December 31, 2002, authorities were refused entrance to the campus monastery, then, on January 14, 2003 they were granted permission into the abby. Reportedly the dog picked up “definite scent activity with both boys but it was stronger with Josh.”

Josh Guimond was a well known and vocal critic of the secrecy behind the sexual abuse charges lauded against several priests located at this particular location. Josh is still missing.

I hope this helps. There is a massive amount of information on the internet regarding these cases. I still haven’t read everything. I do know that all of these cases tie back to the sexual abuse rings mentioned earlier r/t intelligence agencies and international human trafficking - one victim - listed by most people as crazy. I admit, I thought she was crazy too. She and her husband have made a video and posted it on youtube. In the film they show her going to a gynecologist so that the MD can examine her and confirm that she was in fact molest. The shock of that video is what the doctor found - someone (don’t know who) had carved a smiley face into her vagina. And yes, they show it in the film.
All this information is quite heartbreaking. And to know that there is so much more.... It boggles the mind.
