The officials in legally meaningful positions did not challenge Obama’s right to run and did not dispute his election. The Supreme Court has declined to review any of the cases being brought, which means they see no issue worth their time. Whether you, I, or LTC Lakin like it or not, those two things carry definitive legal weight.
I agree that they have “definitive legal weight” but questionable but not necessarily “definitive MORAL weight”. Probably the best course of action should have been to file the lawsuit questioning Obama’s eligibility but still continuing to obey the orders until proven otherwise. Speaking from someone who refused an “unlawful” order during the first Gulf War - I can tell you that the process isn’t pretty - but, at least in my case, those above me agreed with my decision.

You know, I’ve got some ideas as to how this could shake out, but what they all boil down to is this. BHO is entrenched in the White House now and nothing short of an act of God is going to remove him.

The Constitution that I read says that the facts of the matter are everything: if a person is not a natural born US citizen meeting the age and residency requirements, they are not eligible to be president. Period. It doesn’t list any hoops that a person can jump through to magically have those facts no longer matter.
That means that none of those hoops can be used as an excuse for a military officer to give up the fight to defend the actual Constitution. Sec Def Gates has no excuse for accepting as CIC a person who is not factually eligible. He did not swear to defend the political establishment’s decisions or judgments. He swore to defend the Constitution, which allows no certification or other political shenanigans including perjury to negate its requirements.
That’s one way of saying it.

So what I hear you saying is that if a military coup took over the presidency without an election, whoever the false president appointed as SCOTUS would first have to rule that an unconstitutional coup had taken place. Then, and only then, would military people be able to do anything except pick their noses and blindly obey.

It can be plain as day to any thinking person on the planet that an illegal action has taken place, but nobody can do a dang thing about it until the men in the black robes (who by their very appointment have a conflict of interest) tell us what we all already know. How the heck was anybody able to arrest Nidal Hasan, for heaven’s sake? Could an enlisted person have acted as his own “Supreme Court” and decided that Hasan was an enemy combatant without first taking it to SCOTUS? After all, Hasan was a higher rank and somebody watching him shoot up the place doesn’t have the authority to rule on the facts of a matter. Right?
I totally agree with your assessment, however, “probable cause” is usually not sufficient to allow someone to disobey what would normally be a “lawful” order. The crux here is that it’s the “lawful status” of the one issuing the order, not the order itself that it is in question. Because in most cases, if it’s the veracity of the order that’s being questioned, it’s usually pretty cut and dry. But until he’s “proven” (legally speaking) to be usurper, and the orders would be otherwise lawful - I think you have to approach in a different way. Just my two cents...

We have a government where the military has civilian leadership for good reason. If the military was independent of civilian oversight, banana republics result.
Wasn’t this an Article 32 hearing? The court martial is yet to be conducted. At that time he can put on his defense before the court. That court will determine what evidence is allowed, I believe.

Everybody already KNOWS he’s a usurper. His dad was never a US citizen. And he’s committed forgery, bribery, perjury, and misprision of felony in order to not have to show what we know to be a legally-deficient birth certificate from Hawaii.
That means that unless he showed a birth certificate with legal veracity (such as a genuine Kenyan birth certificate) he’s not even legally qualified to be a federal employee - much less POTUS. IF they did an EVVE check on him to check his citizenship status right now, his record would come back with a void flag, showing him as not having proof of citizenship, because of the legally-deficient birth record in Hawaii.

If a person sees evidence that a crime is in process, can they disobey orders in order to prevent or stop that crime in process?
I brought up Nidal Hasan. Could a lowly grunt stop doing his lawful orders in order to stop a crime being committed by Nidal Hasan?
