Obama Nominee for Deputy Attorney General Says 9/11 Attacks Not Acts of War, Likens Them to Domestic Crimes of Murder, Rape Monday, June 14, 2010 By Fred Lucas, Staff Writer

(CNSNews.com) - Despite a resolution by Congress authorizing war against those responsible for the 9/11 terrorist attacks, President Obama’s nominee to be the number two official at the Justice Department, James Cole, wrote an op-ed in 2002 likening the attacks on the World Trade Center and the Pentagon to the domestic crimes of murder, rape and child abuse, while arguing that the attackers ought to be treated like domestic criminals.

“But the attorney general is not a member of the military fighting a war--he is a prosecutor fighting crime,” Cole wrote in a Sept. 9, 2002 article in Legal Times that critiqued the way then-Atty. Gen. John Ashcroft was handling the 9/11 case.

“For all the rhetoric about war, the Sept. 11 attacks were criminal acts of terrorism against a civilian population, much like the terrorist acts of Timothy McVeigh in blowing up the federal building in Oklahoma City, or of Omar Abdel-Rahman in the first effort to blow up the World Trade Center,” said Cole. “The criminals responsible for these horrible acts were successfully tried and convicted under our criminal justice system, without the need for special procedures that altered traditional due process rights.

“Our country has faced many forms of devastating crime, including the scourge of the drug trade, the reign of organized crime, and countless acts of rape, child abuse, and murder. The acts of Sept. 11 were horrible, but so are these other things,” Cole wrote in his op-ed.

It’s pretty blatant now. Can a Chavez like moment be very far off? Will he confiscate the oil companies? Issue an executive order on cap n tax? He has something tyrannical up his sleeve. That’s why he let this spill get out of hand. It serves his ‘greater’ purpose.

In 1998, OBL issued a declaration of war against us. The attacks on 9/11 were acts of that war.

Simply voting these anarchists out of office won't be enough. History has shown that they just retreat to the shadows and continue to snipe and undermine the country from the shadows. They need to be exposed, demonized, marginalized and flushed down the drain. Allinsky them.

Al Qaeda declared war on us in 1996. Al Qaeda planned and executed the 9/11 attacks. More people were killed on 9/11 than at Pearl Harbor. What is it that this man does not understand?

James M. Cole , the man behind the very public investigation of Speaker Newt Gingrich, is by all accounts a very private man.

That display of reserve and self-control would have come as no surprise to those who know him. A longtime friend and fellow poker player, Eric H. Holder Jr., the United States Attorney for the District of Columbia, said in an interview today:

Mr. Cole , who is 44, was chosen for the sensitive post of outside counsel to the ethics subcommittee investigating Mr. Gingrich after assuring Republicans that he would be unafraid to go easy on the Speaker if the evidence warranted.

But as the months went by, he found evidence of a distinctly different kind. It was he who collected and first analyzed enough of it, in documents and interviews, to force Mr. Gingrich last month to take the painful and long-resisted step of publicly admitting that he had brought discredit on the House. And today it was he who recommended what penalties should be imposed.

Given the political stakes, it was not surprising that the committee, made up of equal numbers of Republicans and Democrats, resorted to bitter partisanship as the inquiry moved toward its climax. But while the members hurled accusations at one another in recent weeks, no one — notably no Republicans — suggested that Mr. Cole ‘s approach had been unfair.

One measure of that achievement’s magnitude can be seen in the experience of President Clinton’s chief legal antagonist, Kenneth W. Starr, the Whitewater independent counsel. Clinton supporters have regularly attacked Mr. Starr’s motives, an assault that has been fostered by what even some of the prosecutor’s own backers describe as unwise association with some of the President’s most vocal political detractors.

James Michael Cole was born on May 2, 1952, in Evanston, Ill. He graduated from the University of Colorado, received a degree from Hastings Law School in San Francisco, then returned to Colorado and served as a clerk to a State Supreme Court justice.

His first job after that was at the Justice Department, where he was assigned to the Public Integrity Section. There he forged both enduring friendships and a strong sense of public officials’ obligation to obey the law.

Mr. Holder, a friend and co-worker from those days, says many lawyers would have looked upon the ethics committee job as an opportunity to promote themselves.

“Jim Cole is someone who would never do that — he is extremely discreet,” Mr. Holder said, adding that when they were colleagues at the Justice Department it was nearly impossible to wangle any information from him even about a woman he was dating.

Mr. Holder said he and Mr. Cole had enjoyed a fairly regular poker game with others in the office, a game that continues today among the same crowd, although less frequently now that most of them, including Mr. Cole , have families. (He and his wife, Susan, are the parents of two children.)

In his years at the Public Integrity Section, Mr. Cole successfully prosecuted two Federal judges on corruption charges. One of those cases was particularly well publicized: that of Judge Robert F. Collins of the Federal District Court in New Orleans, who was convicted in 1991 of having taken $100,000 in bribes from a drug dealer awaiting sentencing.

For two years, Mr. Cole has been a criminal defense lawyer for the Washington firm of Bryan Cave. His recent clients have included the girlfriend of former Agriculture Secretary Mike Espy, who is under investigation for accepting corporate gifts for himself and for her.

Before he was hired by the ethics committee, the panel did receive one strong negative review of Mr. Cole : from former Representative George V. Hansen, who was prosecuted by Mr. Cole in the House banking scandal. Mr. Hansen was sent to jail in that case, but his conviction was later overturned by the Supreme Court.
