BREAKING NEWS, 11:50 A.M. est: Matzav.com has learned that Sholom Mordechai Rubashkin ahs been sentenced to 27 years in prison. Sholom Mordechai will also been ordered to pay nearly $31 million restitution when he’s sentenced tomorrow in U.S. District Court.

Chief U.S. District Court Judge Linda Reade issued the sentencing memorandum today, outlining the sentence she will impose at tomorrow’s hearing in Cedar Rapids. Reade indicated in the document she would not impose a fine.

Sholom Mordechai’s attorney Guy Cook says the sentence is unfair and excessive and that the conviction and sentencing will be appealed.

Family, friends and supporters of Sholom Mordechai expressed outrage today. The sentence is greater than the amended recommendation from prosecutors, and is inconsistent with calls from throughout the legal community for Rubashkin to be sentenced in a manner similar to other men and women convicted of white-collar crimes. No problem with jail time. 27 years might be a tad long.

Exactly.

Rubashkin will be able to make most of the 31 million dollar restitution so as far as I’m concerned 7-10 years at the most. This is a BS anti-Semitic scam prosecution

Rubashkin will win his appeal I hope.... those same dopes in Iowa couldn’t wait for their fake messiah 0bama

I’m not sure about the restitution, I think he’s broke, but as to the rest, you’re correct.

The man has business asserts in the millions that will be auctioned off to make restitution. That’s my impression. 27 million in restitution was ordered

Broke after making what restitution he can, that makes sense.

[Judge]"Reade stated in the order that the sentence is within the guideline range and is “firmly rooted in credible evidence” produced at trial, the sentencing hearing and in the uncontested portions of the pre sentencing report. Reade said in her order that no matter what Rubashkin’s motives were, he defrauded the banks out of millions of dollars. “He unlawfully placed his family business’s interest above the victim bank’s interest,” Reade stated. “His family business and he personally benefitted at the expense of all the victim banks’ innocent shareholders.” Assistant U.S. Attorney Bob Teig said this afternoon the defense’s press release and comments today are “nothing new. They are repeats of the misinformation they have repeated for months.” Teig said it’s unfair of the defense to compare other sentences in white collar type crimes because they never give any details of the circumstances in those cases. “We don’t know if they cooperated or accepted responsibility or what,” Teig said. In the sentencing order Reade states she considered Rubashkin’s conduct – he lied under oath at trial, Teig said. Reade wrote Rubashkin lied about asking an employee to create bills of lading to match false invoices. The government submitted evidence of the fake invoices and bills of lading in a folder labeled “Sholom.” Teig offers these sentences of white collar fraud cases – Tom Petters, 50 years; 324 months for Colin Nathanson, 20 years for Michael Riolo; 20 years for Richard Piccoli; 100 years for Edward Okun. The proposed 27 years isn’t unusual in these kinds of cases, he said.

In the Federal Courts is real important to take responsibility for your actions, not lie under oath, and cop a plea if you are guilty...otherwise you're going to do some serious time "within the federal sentencing guidelines"...good luck with that appeal Sholom.

His sentence doesn't appear to be consistant with other sentences for the same crime, though certainly within the judge's authority.

He ripped us poor little taxpayers off for $27 Million dollars of our hard-earned money and you don't think he should be punished with a sentence of one year for every million $$ of the rip-off?

OK then, should we just make him stay after school and clean blackboard erasers, or should we try to get his attention and let him know this is serious?

And here I thought the issue was bank fraud, since that was the crime he was charged with. No matter, heck, let's execute him.

Am I correct in assuming your "taxpayers" comment is based on your support for nationalization of the banking industry? Obama thanks you.

By the way...if I ever have an "Assertation", I will name it after you.

I, at the very least, owe you that much.

So, the locals are "elated" huh. I call it something else.
They subsidized the move and then the company refused to hire them for proper wages, hiring illegals and children.

He is a poor excuse for an American and a "shunda for the goyim." He made Hasidim look bad, but too many in the insular community can't see it. Sad that they blame antisemitism over a criminal.

The charges for hiring children were defeated in court. As for illegals, -huge numbers work every day by business large and small across the land. I am waiting for similar 'justice' to be meted out on them too. I expect to be waiting a very long time.

I read the transcript this of this judge posted in one of the replies. He utterly destroyed him. 27 years. Even the prosecutors didn't ask for that much. Then the townies dance a jig because the big bad Rabbi who wouldn't hire them had it coming. All of a sudden gentiles are concerned with kosher law. Right.

He made Hasidim look bad, but too many in the insular community can't see it.

Oh they see it just fine. They also recognize persecution when they see it. You and I agree on many things, but not on this one. 27 years is too long.
