BREAKING NEWS, 11:50 A.M. est: Matzav.com has learned that Sholom Mordechai Rubashkin ahs been sentenced to 27 years in prison. Sholom Mordechai will also been ordered to pay nearly $31 million restitution when he’s sentenced tomorrow in U.S. District Court.
Chief U.S. District Court Judge Linda Reade issued the sentencing memorandum today, outlining the sentence she will impose at tomorrow’s hearing in Cedar Rapids. Reade indicated in the document she would not impose a fine.
Sholom Mordechai’s attorney Guy Cook says the sentence is unfair and excessive and that the conviction and sentencing will be appealed.
Family, friends and supporters of Sholom Mordechai expressed outrage today. The sentence is greater than the amended recommendation from prosecutors, and is inconsistent with calls from throughout the legal community for Rubashkin to be sentenced in a manner similar to other men and women convicted of white-collar crimes. well, don’t break the law and you won’t have some hard ass judge throw the book at ya.
I think PETA, although I recall this was a prosecutor that decided all Jewish people should be denied bail, since we can flee to Israel.

The problem I have with this case is, what did Rubashkin actually do that was criminal? We are in the state of affairs Ayn Rand predicted, where there are so many laws that even honest citizens can't help but break some if they conduct extensive business. (I am NOT a big fan of Ayn Rand!)
Whatever his crime, 27 years, on top of full restitution, is the kind of sentence I'd like to see handed down to rapists, kidnappers and aggravated assualts. There would have to be ruined lives in the wake of Mr. Rubashkin's crimes to justify 27 years. That's about 1/3 of a lifetime!
From the article, I cannot figure out what he was convicted of.
He ran a meat-packing plant full of illegal immigrant workers (many of them children). He was convicted of mail fraud and money laundering for defrauding the plant’s banks and other creditors.
Bank/wire fraud. Without going into details, he lied on various financial statements and representations to his bank in order to obtain financing after the company was in financial trouble. He deserves prision time, but sentences should be proportional to the crime, and other violators.
What is the reasoning given for such a length of time in prison? It doesn’t seem appropriate when viewed against other similar cases.

Ah. Well... exploiting children for labor is a BIG no-no as far as I am concerned. Just because he is Jewish doesn't mean he should be exempt from the law.
Although, one should take notice that some of the Islamic terrorists served less time in Gitmo than he will serve.

He claims to have been unaware of that. I don't believe him, but others were convicted for those crimes, he wasn't even charges, so the sentence cannot be based on that. It's my understanding that testimony along those lines was allowed during the trial, which I suspect may earn the taxpayers the bill for a new trial. But in any case, employment of illegals was irrelevant.
As I noted in 17, I'd be happy to throw employers in jail for employing illegals, perhaps not for 27 years. But to do that you have to be willing to charge and convict them. Which despite extensive investigation, didn't happen here.

His company, over the years, has violated just about every health law known to science and each time they just got a slap on the wrist.
He had illegal Mexicans working there and even violated child labor laws.
Locals thought he would get by with this stuff and are elated that he will finally have to pay the price.
He lied to the bank. This looks like a crime that would warrant 5 years. 27 years is insane. This is federal court, meaning that 27 years really is 27 years.
