These statements are part of an ongoing 2010 series of conversations, interviews and press releases from former Congressman and conservative icon Duncan Lee Hunter. The intent is to keep this rock ribbed conservative’s ideas in the public square which will hopefully influence the direction of the Republican Party, as well as inspire the American people to embrace his Reaganesque views on American life and politics. The statements regarding Obama’s Amnesty are from 6/29/10. And the statements regarding Kagan are from 5/17/10.
ON OBAMA’S EXECUTIVE ORDER AMNESTY PLAN
AJM: So Congressman, what did you think of that Fox News piece that said Obama may be planning a unilateral, executive order Amnesty for illegal aliens? And that a group of Senators sent Obama a letter warning him against such a move?
DH: Anything that sounds like amnesty, even if it is just discussed, people will pack up and head for the border hoping to get in. And then when you have one, they write home. You know the 12 to 20 million that are here now are folks that didn’t read the fine print when we gave the first amnesty in the 80s. We legalized 3 million people and in the fine print it said “now this is it, nobody else is allowed”. They said “Right. Flossi, make sure you pack the extra set of socks, it’s hot in the Arizona desert, you know”. I mean they immediately came over in big numbers. That’s human nature.
AJM: Yeah, and Obama is doing absolutely nothing to secure the border as he contemplates this grand amnesty. And what about the ‘separation of powers’ issue associated with that.
DH: Yeah, obviously this would be attempt at usurping authority. You’ve always got a tug-of-war between the President and the Congress in terms of what you can do. I would think that the Constitutional prerogative for the President to act unilaterally on amnesty is, I believe, very limited. He might be able to bootleg it on the basis that the President has a right to absolve people of a crime. For example, Ford’s giving amnesty to the draft dodgers in Vietnam, right?
So the President can give amnesty for a crime, so possibly, that’s what Obama’s lawyers have been looking at. You simply declare – instead of giving amnesty to one person for a particular crime, which would be thoughtfully considered - you’re going to give 12 million people amnesty for crimes in a sense.
However, that would give them the full reward for their criminal behavior! The point of giving people amnesty for a crime is that you relieve them from the burden of punishment, but that you don’t reward them for it. The essence of giving amnesty to people who have come in to the country illegally is to give them the full reward of their illegal acts. It’s the equivalent to saying “you’ve committed a crime by taking something, and now I’m going to let you keep it”. He’s not going to punish them, he’s not going to fine them, or incarcerate them for coming across illegally, he’s going to allow them to have the full reward and release of the law. So essentially, it is the total neutralization of our laws. The total elimination of the law, and we can’t let it stand.
AJM: Exactly. Congress has made many, long established laws, over many years on how we deal with this particular issue. For the president to unilaterally think that he can change the terms of the law, just because he thinks it’s in somebody’s best interest – I’m not sure whose – strikes me as another power grab.
DH: Yeah. No, I agree with that. Essentially, it would be the undermining or eliminating our nation’s immigration laws.
AJM: What do you think the consequences should be, I mean what does Congress do if he actually goes through….
DH: I don’t want to speculate. The Senators think they’ve gotten wind of something happening: They send a letter out to the Executive branch. They get an answer back the next day that says ‘no, we just had one leftwing lawyer who was looking at this on his own hook, but nobody is following up on it and it won’t happen’.
AJM: Well hopefully that is the case.
DH: On the other hand, that one leftwing lawyer (laughing), it may be Mrs. Obama. Who knows?
AJM/DH: (laughing)
DH: Or maybe Obama himself, right? ‘There’s only one nutty, leftwing lawyer in the Whitehouse looking at this – his name is Barack Obama. But don’t worry’!
ON ELENA KAGAN FOR SCOTUS
AJM: John Paul Stevens, the eldest and most liberal member of the court, and Barack Obama’s nominee is a gal named Kagan. I can’t remember her first name. Kagan is her last name. I thought this would interest you. She was the head of the Department of Law at Harvard University. It sounds like a good credential, right? But when she was the head of Harvard Law, she is the one that booted the ROTC off of that campus. And she is very much against, vocally against, the Don’t Ask Don’t Tell policy and therefore was instrumental in keeping the military off Harvard’s campus. I think on just THAT ALONE, that should be enough to oppose her nomination, do you think?
DH: Well, I think this is just another reflection of the fact, just another piece of proof, that liberals love everything about freedom except for the people that fight for it and give it to them.
AJM: Yeah, it’s incredible. But does a person like that, I mean do you…
DH: If you are asking me if I would vote for a radical Obama selectee, or nominee for the Supreme Court, the answer is a definite NO. (laughs)
AJM: (laughing)
DH: I think that’s a pretty easy one for you there, Jim.
Don’t feel like you’ve got to do a lot of convincing me. We need folks capable of understanding the plain language of the constitution, not some liberal activist who can’t quite grasp why it is that America remains a free nation. We’ve got enough of these confused lefties in the Congress, we don’t need them on the Supreme Court.
So you can put me down as a ‘no’ on Miss Kagan.

I think negative publicity is the best way to kill off both Obama’s secret amnesty as well as Kagan’s approval.
Unfortunately, since the President may have authority under Article II, Section 2 of the Constitution, our options to fight might be limited:
"The President ... shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment."No standards, and only one limitation -- no pardons for the impeached.
I wonder if we could do a pre-emptive blanket "impeachment" of all of the illegals before he pulls this stunt. Thus devoiding him of this power for this particular nebulous group.
How do you "impeach" an illegal alien? Article I, Section 3, Clause 7 reads:
Clause 7: Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.The Illegal Alien is clearly seeking to avail themselves of "profit under the United States" by their conduct, and also "trust" wherein they deceptively masquerade themselves as citizens. This gets us into the jurisdictional grounds for a mass impeachment.
The man who SHOULD be sitting in the Oval Office.
There is little doubt that Obama and his minions believe they have the power to do this. That is why we need to raise our voices to make sure it is politically undesirable for him to try.
This could spark revolution
If Obama keeps this up, we will need another General Washington.
BTW, Ford was in also on the draft dodger phenom.

Hunter is the only one I have heard that has gotten the illegal situation right.
This man would make a great President.

And that is something Duncan Hunter understands and the ‘progressives’ (including john mccain) ALWAYS ignore...HUMAN NATURE.
They will get away with just as much as we allow (aliens & progressives!) ignoring human nature....blood is thicker than water, ingrained racial attitudes so dominant in the invasion culures, and the fact that NO people want to be invaded!
The other thing about the McCains of the world, is they always have their fingers in the wind. Their first order of business is their own political hide. I cannot think of a single issue that Hunter has felt compelled to do an about face on.

I am still concerned whether we will even be allowed to have the elections in November. I have absolutely no question that "O" is strongly tempted as a tyrannical communist to pull Hitler's REICHSTAG FIRE stunt....
If we are, with God's help, given a chance to restore America, and to oust the rats, the Congress must more or less immediately declare complete war on Obama's administration. Not a single penny for his Healthcare, Bailouts, Czars, Global Warming Tax scheme, his running around the planet with Air Force One, or for Michelle Obama's huge 'staff'. No money, no more revolution. And NO AUTHORITY to run the printing presses.
And then immediate investigations into everything, from full auditing of the Fed, Goldman Sachs, Geithner, Bernanke, and having real numbers issued from the CBO on all areas, and put an immediate freeze on all spending, or debt issuance. Especially to the Chinese. And perhaps a serious Congressional inquiry into the citizenship status of the White House occupant. If the "conspiracy nuts" are right...as a legal matter...we win. Nothing he has signed will be a legitimate law...
And no compromises on any of this.
