DoJ's risky Arizona lawsuit gamble

On Tuesday, President Obama’s Department of Justice moved to sue Arizona in an effort to overturn the state’s recently passed immigration law known as S.B. 1070.

Arizona Governor Jan Brewer is named as a defendant along with the state, responded in a statement saying “The irony is that President Obama’s Administration has chosen to sue Arizona for helping to enforce federal immigration law and not sue local governments that have adopted a patchwork of ‘sanctuary’ policies that directly violate federal law. These patchwork local ‘sanctuary’ policies instruct the police not to cooperate with federal immigration officials."

At least five other lawsuits against Arizona's law have been filed since April.

Good for you, Governor Brewer. Keep pushing that fact in the press, and down the Democrats' throats. They can't refute or defend that hypocrisy.

Excellent article. GREAT contrast on inane DOJ emphases.

I like this Governor Brewer. She has brushed off several attempts to twist her arm, including a one on one with the Zero itself. The pressure on her from “Principalities and Powers” must be enormous right now. This brave and determined woman needs prayers. She is in the forefront of the battle for every law abiding citizen right now, and the rule of law itself. She is personally opposed by men of lawlessness, with all which that entails.

Here is the juicy part:

Mr. Kobach finds it hard to believe that the government, in the Arizona case, is bringing a case where there is “not a single precedent in all the federal appellate court opinions or Supreme Court opinions that support” the case. “So, they’re doing the legally unwise thing in both instances—the legally questionable thing.”

The government’s odd behavior in the legal process does make the co-author of Arizona’s law suspicious, though, if there is something more political going on at DoJ than what is being admitted to.

I think they're doing this so that later they'll say that the judiciary cannot be trusted to do the right thing and try to impose something through a Hugo Chavez sort of executive order.

My fear is that by laying their cards down, they are showing that, no matter what, they will do anything, even obviously illegal things, then dare us all to do something about it. They are acting like they have an ace in the hole, and that worries me.

Whatever comes of the Arizona case, they will make all of these poeple illegal after the elections. Obama will be relected with 12-16 million new dems.

They are suing AZ because AZ has called them on their failure to meet their constitutional responsibility to provide for the national defense.

After all of the drugs, kidnappings, and murders, a normal congresss would move to impeach the persident so that a replacement would get the message to protect the citizens.

She needs to up the ante -- Arizona needs to continuously distribute the list of all such sanctuary cities, and even offer to pay the one-way bus fare to the place of their choice, just to get rid of them. Gee, I wonder what *that* would do to "sanctuary" policies and the legislatures in other states? Thanks paltz.

None of the complainants have standing to bring these suits, they are not Mexican illegal aliens subject to Arizona law itself.s/

“That tells me there are some very perverse political forces at work either within the Justice Department or in the White House forcing the Justice Department to do this, and I don’t know which it is, but its really troubling.” Arizona’s new immigration law goes into effect on July 29.

Speaking as a Texan, I’m glad Texas wasn’t the first to make this stand. I don’t believe our governor Rick Perry is man enough to stand up for his state as boldly as Jan Brewer is standing up for hers.

It’s shameful when a nation’s women have to do the men’s job, but apparently that’s what America has come to.

A source within ICE has informed me that agents have been told that they have no more room to hold people, so that they can only hold those who already have at least a felony conviction. The previous standard was two misdemeanor arrests for drug violations.

I am also hearing that the ability to pursue people believed to be illegals is also being degraded. Is there anyone else who can confirm or deny these allegations?

Worth repeating! I'm so proud of Gov. Brewer standing up to this corrupt administration. My only regret is that we're gone for the summer. Would love to be back there to see the effects of the new law.

However, my family and FReepublic will keep me informed!

He wants a race-war and is using federal thuggery to kick it off. He could care less about the rule of law and why it is in place. His doesn’t give a damn about the founding laws of sovereignty and quite honestly should be impeached or arrested.

Went grocery shopping earlier in a store that caters to Mexican and Mexican-heritage persons. (in Tucson) As we left the store, we were approached by some young males who were registering people to vote. lol Most of the clientele of this store speak Spanish first. The only times I remember anyone asking me to register to vote have been at DMV/MVD type establishments. And then today.
