Justice: Sanctuary cities are no Arizona
No plan to file lawsuits for refusing to cooperate with feds
The Obama administration said this week that there is no reason to sue so-called sanctuary cities for refusing to cooperate with federal authorities, whereas Arizona's new immigration law was singled out because it "actively interferes" with enforcement.
"There is a big difference between a state or locality saying they are not going to use their resources to enforce a federal law, as so-called sanctuary cities have done, and a state passing its own immigration policy that actively interferes with federal law," Tracy Schmaler, a spokeswoman for Attorney General Eric H. Holder Jr., told The Washington Times. "That's what Arizona did in this case."
But the author of the 1996 federal law that requires states and localities to cooperate says the administration is misreading it, and says drawing a distinction between sanctuary cities and Arizona is "flimsy justification" for suing the state.
"For the Justice Department to suggest that they won't take action against those who passively violate the law --who fail to comply with the law -- is absurd," said Rep. Lamar Smith of Texas, the ranking Republican on the House Judiciary Committee and chief author of the 1996 immigration law. "Will they ignore individuals who fail to pay taxes? Will they ignore banking laws that require disclosure of transactions over $10,000? Of course not."

Local police can ask for all the papers they want, spend all the time in the universe filling out their own paperwork - but the local police still cannot deport people. They have to hand them over to the Federal government authorities, who aren’t deporting anybody.
That’s why I think the AZ law was merely symbolic and stupid. Pass a real law that prevents (a) “sanctuary cities” from receiving any state aid, and (b) anyone in the state from receiving state benefits, including schools, unless they can prove citizenship.
The difficulty here is that because of birthright citizenship, there will be many non-legal immigrants whose kids actually will be legal immigrants and thus will be eligible for benefits.
So how does a state handle that? Or how does a state handle it when Obama declares all visa overstayers (most of our worst terrorists came from this group or from legal, naturalized citizens) to be legal immigrants?
Brace yourselves, because it’s going to happen. He wants more Muslim immigrants, he’s already expanded their quota, and he’s going to get them. And they’ll all be legal.

The current DOJ is out to make border laws unconstitutioal. The DOJ should be put in jail.

All of your points are well stated. We’re in a mess, no doubt about it. In terms of an increase in Muslim immigrants, you are again so right. I’ve been reading Andrew McCarthy’s book and it’s depressing how political correctness is leading to our ruin. Even under Bush, the visa “overstayers” were not dealt with...and with Obama, it’s of course even worse.

We do not need the drug dealers, terrorists, rapists, and other criminal illegal aliens - we have enough criminals of our own.
Not only does the government favor them, but MSM is cheering for them with sob stories. Often they even fail to mention that somebody is an illegal alien.
One example: a Tanveer Fayyaz, 31, is on the run - a taxi driver who raped in Maryland a disabled woman he was transporting. From the name, I would guess he is not likely a citizen. But the article says nothing of his background or nationality.
More lawlessness by the Obama Administration.
