PHOENIX — Arizona shouldn't have to suffer from the country's broken immigration system when it has 15,000 police officers who can arrest illegal immigrants, state attorneys argued Thursday in the first major hearing on challenges to a strict new immigration law.

[snip]

Attorneys for Gov. Jan Brewer told Bolton that the lawsuit — filed by Phoenix Police Officer David Salgado and the statewide nonprofit group Chicanos Por La Causa — should be dismissed because Salgado and the group lack legal standing to sue and that there's no valid claim of immediate harm.

Article describes PPD officers standing outside the courthouse to keep the peace; carrying guns and handcuffs.

What? Don’t they all? Why is that newsworthy?

So - the Arizona law is unconstitutional because it means that Arizona is enforcing immigration law?

Tell me, if you violate immigration law in Arizona by being in the country illegally, what’s the charge? What kind of trial is held? What penalties are assesseed if you are found guilty?

None. Because they’re not enforcing the law. What they do is turn you over to the Feds so that they can enforce the law. Or, as I suspect will be done by the Obama Administration, they can simply let you go.

"He does have a real threat," attorney Stephen Montoya said. "They can fire him. That's enough."
A law enforcement officer hired to enforce laws can be fired for not doing his job of law enforcement?...Who knew?

I guess he thought he could just pick and choose which laws he wanted to nforce and which ones he didn't.
