Testimony Sought of “Custodian of Records” AND Production of all records relating to President

Decision to be made by Army Major General

Washington, D.C., July 29, 2010. The Army doctor who is facing a court martial for refusing to obey orders, including a deployment order for his second tour of duty in Afghanistan, has formally requested his Commanding General approve a deposition in Hawaii of the records-keeper of the State Department of Health—and the production of all of their records concerning Barack Obama.

The records Lakin seeks have been the subject of intense interest ever since the closing days of the 2008 presidential campaign when a document appeared on the internet purporting to be a certification that Hawaii’s Dept. of Health had records showing he had been born in Honolulu. Since then, Dr. Chiyome Fukino the head of that agency has made public statements on the subject, but has refused all requests for copies of the actual records in the Department’s custody. Recently, a former Hawaii elections clerk has come forward saying that he was told that the Department’s records showed Obama was NOT born in Hawaii.

The United States Constitution requires that a person be a “natural born citizen” to be elected to the presidency. If Mr. Obama was not born in Honolulu as he has claimed, then he is unlikely to be a “natural born citizen”. An examination of the records kept by the Hawaii Dept. of Health are an essential first step in ascertaining Mr. Obama’s constitutional eligibility to hold the office to which he was elected in 2008.

While no civil litigant has obtained discovery of these records, and all the civil lawsuits seeking those records have been dismissed on procedural grounds, Lakin’s case is different because he is the subject of criminal prosecution, and upon conviction stands in jeopardy of being sentenced to years at hard labor in the penitentiary.

Lakin’s request was submitted by his counsel to the Commanding General of the Military District of Washington, Major General Karl R. Horst, under Rule 702(b) of the Rules for Courts-Martial, which provides that “A convening authority who has the charges for disposition or, after referral, the convening authority or the military judge may order that a deposition be taken on request of a party.”

Lakin’s civilian attorney has been provided to him by the American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, which has established a fund for Lakin’s legal defense to LTC Lakin. There is nothing to discover.

Yes there is. A valid birth certificate would prove, in a legal sense, who his father was. So even if everything on the CoLB image was correct, which is highly unlikely given that it is a forgery, then BHO junior is not a natural born citizen.

Sure that fact is generally known, but not in a legal sense. Right now, it's just hearsay. But if the BC, or even a valid, newly produced, CoLB, were entered into evidence in court, then it becomes a legal fact, unless challenged of course, with counter evidence.

I agree with you, which is why a simple 12 dollar fee from Obama to the records department in Hawaii would prevent a perfectly good Army officer from being destroyed. How many millions of dollars has Obama spent on lawyers and court costs to prevent people like Lakin from seeing his documents, and yet he cannot toss in 12 bucks to easily close this case out?

The FACT that Obama refuses to do this humble and simple act, and most likely KNOWINGLY allows Lakin to be destroyed is what disturbs me the most in all of this.

But that isn't what either they or I said, was it Mr. Rogers.

Senate Res. 511 made no reference to Obama, who was one of its co-sponsors. Whether Obama is born outside of the U.S. is unknown, and being well concealed by the regime, possibly even to the extent of the murder of Lt. Harris, who "cauterized" Obama's passport files for Obama security czar Brennan, and certainly the reason behind the prosecution of the nine school testing technicians who may have had access to Obama's educational records. That Obama was born of an alien father is all the evidence needed to show ineligibility. Your job is to confuse people by changing the subject, or lying. You have been effective, but the conservative majority will learn the truth eventually.

And anyone claiming Obama has dual loyalty to the UK is an idiot.

I guess that makes the House of Commons and the Crown idiots because they passed the 1948 British Nationality Act, and Obama an idiot becuase he said on his own web site, fightthesmears that he was born a dual citizen. Our framers were concerned with allegiance at birth because that would probably affect loyalty at majority. They were correct.

People for whom Marxism is the end are not necessarily "idiots." People using the term are usually bereft of coherent arguments. This is a struggle for power. The ruling class has not learned from the failure of the USSR, or the pain of the Cubans and growing pain of the Venezualans.

If Russia wanted, they could declare all US citizens to be Russian citizens...and we would ALL be dual citizens, and then no one could be President. Of course, what the Founders were concerned with was foreign loyalties, and Obama has ZERO loyalty to the UK.

If the Army allows the deposition, and the State of HI has no document, just a form from Granny .... it could get fun!

The army denied every other request for documents or witnesses relating to Obama's eligibility because they are irrelevant to the charges Lakin is facing. I don't see them changing now.

His CO's behavior 20 years ago has ABSOLUTELY NOTHING to do with his behavior now, because he has evidently become more concerned with his career than the lives of his subordinates.

Of course he is.

Lakin's CO would sooner see Lakin get destroyed before he took a stand for him.

Considering it was his order that Lakin is charged with disobeying then I would expect he will be on the stand testifying against Lakin.

Based on folks I know, I’d say MOST military members think Lakin is in the wrong. And yes, I remember when we had enlisted folks saying they would refuse deployment because Bush was selected, not elected...a talk with legal followed by a talk with the CC convinced them that would not be a good idea.

I have no use for anyone who refuses to deploy to a combat zone. If he wishes to refuse an order to go to work...fine. But I long ago lost count of how many times I deployed, and have no use for anyone who ducks a deployment.

And I also have no use for anyone calling a Medal of Honor winner a coward based on their decisions about the law.

But Obama's birth condition isn't an artifact of some asinine oddball ruling like that. His father had loyalty to the UK, and by operation of well established and recognized law, at least some form of that loyalty passes to his children.

The same holds true for naturalized citizens. But that isn't the criterion set forth in the constitution.

The criteria that you assert holds, as a matter of law, makes birth-vacation babies eligible, even when both parents are non-citizens and the child is reared to adulthood in a foreign land.

This is one of the silliest arguments proposed. We don’t have to come up with irrelevant hypotheticals as Obama’s own website admits he and his father were governed by British law. There’s no ‘ifs’ to it.

Lakin is a hero. The military is learning that the coup is filled with Muslim Brotherhood and Hamas moles plus CAIR. Intel is going back to Al Qedea and the Taliban to kill our troops. The members of the military are slowly catching on that they are being used.

The resolution passed was on McCain, who was born overseas to 2 US parents. To pretend it is supposed to apply to those born in the US is dishonest. This ‘troll’ says you are a liar...and you’ve proved it here.

BS! It was well accepted prior to anyone hearing of Obama that someone born in the USA was a NBC. There is room for doubt on that question, and it was not unanimous, but it was well accepted. Many writers from the beginning held that view, and by the mid-1900s it was the dominant view.

And yes...anyone claiming Obama has mixed loyalties because he is REALLY a subject of QE2 is an idiot. And thus you and your friends lose every single time.
