Iowa City man sues U.S. over health reform

An Iowa City man temporarily residing in Toronto, Ontario, Canada, to study art has filed a lawsuit against the United States, challenging the constitutionality of the federal Patient Protection and Affordable Care Act, according to a complaint filed July 26.

An "individual mandate" in the law requires that everyone purchase health insurance or be subject to a financial penalty.

Matt Sissel, 29, stated that he is able to and does pay for a all of his medical expenses out of pocket.

Sissel's counsel, the Pacific Legal Foundation, argues that Congress cannot force individuals to purchase health insurance under the Commerce Clause, according to the lawsuit.

They were founded by Reagan inner circle members Ed Meese and others to counter the ACLU and the Sierra Club, which were running roughshod over California, in particular.

Not much has changed.

Things got confusing. House passed Senate’s version. Then in a separate process some changes were voted to that version: http://tinyurl.com/yfj4bz7

But whichever version is was, we’re still only gradually — drip, drip, drip — learning what’s in it. The “individual mandate” is there, no question. And that is what the legal challenges are targeting, from what I can tell.

The senate version.

which passed at 1am on christmas eve.
They were going to fix it up in conference but then Scott Brown
happened so the only option was the Senate bill up or down,
plus “fixes” in the budget reconciliation. Those fixes were takeover
of student loans, etc.

repeal obamacare this session! tell your rep to sign the discharge petition by Rep. Steve King. They have 163 members, once it gets to 218 they
don’t need Pelosi or anyone.

Thanks! That's good news.

Any attempt to enforce the mandate as a tax would be unconstitutional (see Article I, Section 7, Paragraph 1) - "All bills for raising revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other bills."

So, the individual mandate will be struck down by any constitutionalist judge, that means nothing to Zero, Pelosi, and Reid.

Sorry, but the more important issue is whether the government can prevent me from getting whatever kind of health care I choose. It is now supposedly illegal for me to buy my own health care with my own money, via cash or other personal financing. Not being able to choose to buy an insurance of my choosing is less important.

Eg., person A is diagnosis with serious health issue H. The government is pretending that they decide whether you get care for H or whether you are required to crawl into a corner and die?! Even if you want to use your own resources to fund the care that could save your life, you'd be a criminal if you did.

Gov, DC gov, is totally out it's lawful mind.
