I have worked on some sites where you would not believe what they make some illegals do. We had one guy down a hole that was being hand dug in a hill side for a piling that was about 25 feet deep about 3 feet in diameter he was filling up 5 gallon buckets with a small shovel scary
Apparently the contractor hasn’t been to Competent Person course lately to learn how to use trench shoring to stop this tragedy!
You know, I was thinking in the wake of forcing Arizona NOT to help enforce immigration laws on the books that the Feds have opened themselves up to wrongful death lawsuits from families of citizens killed by illegals via auto accident or murder(s), etc.
Now I see the illegals might be able to take advantage too.
If the contractor is a US citizen, prepare to meet Mr. OSHA.
If the contractor is a Mexican illegal, prepare to meet the border crossing.
Where are the pro union guys? They always say they fought for safe work environments but my union (SEIU) wants as many illegals as possible streaming across the border.
Oh I agree completely. Anyone who loses a loved one in Arizona due to illegals need to sue the feds for not doing their constitutional duties and for preventing Arizona from doing them. I think they’d win.
Yes... the greedy contractor weighs his options. Hire Paul the American, screened after many applications through a contract labor agency, who might think manual labor beneath him, who will demand a W-2 form and taxes withheld, 15 minutes of rest every four hours plus one hour for lunch, safe working conditions, and at least the legal minimum wage, OR hire Pedro the illegal, picked up on the street corner or at Home Depot or at the railroad tracks, Pedro who is illiterate in English and illiterate or barely literate in his own language, who will do anything el jefe says, even if it endangers his life and health, and who will work for peanuts, and who can be discarded like a used Kleenex when he's outlived his usefulness--which one does the greedy contractor who wants to cut corners and make a quick buck hire?
Not that hard to figure out.
I was at one work site where construction worker (Hispanic, didn't know his legal status, but he wasn't American born) working on a lathe without eye protection. I started YELLING at him to get eye protection, and he seemed taken aback, and said he would, and then went back to his work as if nothing had happened. I was angry. I wondered who had hired him and who had neglected to take care of this worker's safety on the job.
So, when I read of tragedies like this, I think of the greedy employer who will abuse and discard the illegal aliens who are desperate for the most dangerous and low-paid work, knowing that the workers can't complain if they are abused or injured. Or worse.

I’m not a lawyer, I’d like to know that since the Feds went out of their way to prevent Arizona from enforcing the law, can Obama or Holder (or both) be sued for wrongful death in future deaths.
If so I think that’s the route to go.

My son was checking on the boss’ son one day, he told him that the ditch was unacceptable and told the laborer not to get in the ditch. The other guy was telling him to get in and get the job done. The guy was standing at the edge trying to figure out who to listen to when the whole ditch collapsed and took him with it.
My son had enough adrenaline that he was able to jump in and throw the guy out and after that he had enough left over and was going to kick the boss’ son’s arse. He found him behind his backhoe puking his guts out so he had mercy.

That reminded me of the zoo worker in the Bangkok Zoo who had just given an enema to a huge male elephant. The enema was instantly successful. The Zoo worker died in a crappy way.
Yes, those of us who want border control are often portrayed as haters of Mexicans, but there is a protection for you in being here legally. It is not in a Mexican’s interest to be here illegally, at least not usually. You can, obviously, be badly exploited.
Which is what I think a LOT of the pro-illegal crowd wants.

The construction company that hires illegal aliens (doesn’t care about following government immigration law) will suffer tragic workplace accidents (doesn’t care about following government workplace safety standards).
