Democrat Ben Nelson Opposes Elena Kagan, Will Vote against her confirmation (Do you believe this?)

Nebraska Democrat Ben Nelson announced late Friday he would vote against the confirmation of Supreme Court nominee Elena Kagan.

In a statement released this evening, Sen. Nelson said, "I have heard concerns from Nebraskans regarding Ms. Kagan, and her lack of a judicial record makes it difficult for me to discount the concerns raised by Nebraskans, or to reach a level of comfort that these concerns are unfounded. Therefore, I will not vote to confirm Ms. Kagan’s nomination."

Nelson is the only Democrat to oppose Kagan at this point. Five Republicans, on the other hand, have said they will support Kagan's nomination, giving her more than enough votes to win confirmation. A vote is expected in the Senate late next week.

Nelson has sided with Republicans on a number of votes in the past, most recently the restoration and extension of unemployment benefits for the long-term jobless.

Would he do the same if he were the decisive vote?

I doubt it. Nelson is good for a Democrat and better than some Republicans, but I doubt it.

Wow, good for him. Making amends for his bad health care vote perhaps.

You would think Sen Lincoln, being almost sure to get defeated, would vote against Kagan too. But maybe she figures she has nothing to lose. Even if she did vote no her vote would probably be canceled out by Snowe, Collins, Brown, and maybe Gregg. What a shame. Makes it all the more upsetting they couldn’t have scrounged up a few thousand more votes in the last 2 elections so Sens Allen, Burns, Stevens, Coleman etc might still be there.

This means a RINO agreed to vote for Kagan so Ben could repair his image back home.

No. Any vote against her confirmination is only to fool the peasants. There will be more than enough votes for her confirmation.

The voters really done themselves proud in 2006 and 2008. Soon they will learn for themselves how proud they can be.

Harry ‘the serpent’ Reid has more than enough votes to confirm the slug, so some of the vulnerable criminal party memebrs will be allowed to feign non-support for the commie slug.

If he was the 41st to filibuster then it would mean something.

Just pandering and worth nothing.

I believe it. There is no courage here as Kagan will likely be confirmed.

I have a good friend in Omaha who tells me that Nelson is still booed out of restaurants for his health care vote.

Exactly...

Smoke and mirrors. Just like with health/deathcare; some voted against it only when they were sure it would pass.

I love it! He was a total dirtbag by taking that bribe. Americans see this crap and are sick of it. Term limits for all!

I’m sure he was given permission to vote no, they have the votes to confirm her, so they’re giving him an out on this.

No, I don’t believe it. He’s signaling that he wants a little retirement money to change his vote.
